Abstract

Intangible cultural heritage is a heritage that is passed down from generation to generation. Therefore, it is important to be protected. This research aims to find out the implementation of the legal protection on Intangible Cultural Heritage which is regulated in the Convention for the Safeguarding of the Intangible Cultural Heritage 2003 and to recognize the necessary endeavor by Indonesia to formulate the protection on intangible cultural heritage in the framework of the Convention. The problem of this research is that the legal protection on Intangible Cultural Heritage in Indonesia has not been able to provide optimal protection. This research is normative conducted by reviewing literatures related to the problems. The research concludes that the legalprotection on intangible cultural heritage has been regulated in the convention for the safeguarding of the intangible cultural heritage 2003 and also in the Ministerial and Cultural regulation Number 106 year 2013 about intangible culture heritage. So itis needed to set sanctions in the Convention for those parties who fail to fulfil their obligation to safeguard and protect the intengibile cultural heritage in the national level.
