Abstract

ABSTRACT This scientific article discusses the right to manage land arising on the edge of a river, which in this scientific article the object of research is in the Batanghari River Basin (DAS), Penyengat Bawah District, Jambi City. The discussion in this scientific article is about how the right to manage land arises on the banks of the Batanghari river based on the applicable laws and regulations, the research method used is to use empirical research methods in which researchers go directly to the community to obtain definite data about land management. the arise. Based on the results of the research data, it can be seen that the community manages the land due to several factors, namely firstly because they have lived for generations and use the arising land from generation to generation as well. Second, because it is difficult to find land in the city of Jambi to carry out farming activities and can support the residents' economy. Third, the price of land is quite high in the city of Jambi and fourth, they are accustomed to using land on the banks of the Batanghari River. However, the management and control of the land has not been accompanied by permanent legal force as stated in Article 16 paragraph (1) of the Basic Agrarian Law. ABSTRAK Artikel ilmiah ini membahas mengenai hak mengelola tanah timbul dipinggiran sungai, yang mana dalam artikel ilmiah ini objek penelitiannya adalah pada Daerah Aliran Sungai Batanghari, Kecamatan Penyengat Rendah Kota Jambi. Adapun pembahasan dalam artikel ilmiah ini adalah mengenai bagaimanakan hak mengelola tanah timbul di pinggiran sungai Batanghari berdasarkan pada peraturan perundang-undangan yang berlaku, metode penelitian yang digunakan adalah dengan menggunakan metode penelitian empiris yang mana peneliti langsung turun kemasyarakat untuk mendapat data secara pasti mengenai pengelolaan tanah timbul tersebut. Berdasarkan hasil data penelitian di dapat data bahwa masyarakat mengelola tanah tersebut dikarenakan beberapa faktor, yaitu pertama dikarenakan telah tinggal secara turun temurun dan memanfaatkan tanah timbul tersebut secara turun menurun pula. Kedua, dikarenakan sulit mencari tanah di wilayah Kota Jambi untuk melakukan kegiatan bercocok tanam dan dapat menopang perekonomian warga. Ketiga, harga tanah yang cukup tinggi di wilayah Kota Jambi dan keempat, sudah terbiasa menggunakan tanah timbul di pinggiran Sungai Batanghari. Namun pengelolaan dan penguasaan tanah tersebut belum dibarengi dengan kekuatan hukum tetap sebagaimana yang terdapat didalam Pasal 16 ayat (1) Undang-Undang Pokok Agraria.
