Abstract

Abstract Political law in the state is an embodiment of the "ideals" or "rechtidee" of the state formation and these "ideals" are usually formulated in a constitution. Politics of state law can be seen from the legal position in the country, if legal decisions over politics, then the country prioritizing law over politics, conversely if the politics over the law, so the country gives priority to politics over the law. Human rights include not only juridical issues but also political issues. The legal and political views of state law determine the position of human rights within the boundaries of freedom and human rights within the state.
