Abstract

THE SETTLEMENT OF TRAFFIC ACCIDENT CRIME CASES THROUGH RESTORATIVE JUSTICE ABSTRACT This thesis research discusses the Settlement of Traffic Accident Crime Cases through Restorative Justice, with the issues discussed are: 1) How to Arrange for Traffic Accident Case Settlement through Restorative Justice Justice? 2)What are the legal consequences for the settlement of traffic accident cases through Restorative Justice? With this problem, the research method used is normative juridical research with a statutory approach, a conceptual approach, and a case approach. The legal materials collected are: primary legal materials, secondary legal materials and tertiary legal materials. Analysis of the collected legal materials is carried out by means of; inventory, systematize and interpret. The results showed that: 1) Arrangements for the Settlement of Traffic Accidents through Justice Restorative Justice has not been regulated in positive law, however, case settlement through restorative justice has been mostly carried out by referring to several regulations related to case settlement through restorative justice. 2)Legal consequences for the settlement of traffic accident cases through Restorative Justice, that the peace agreement is the beginning of the issuance of a peace deed (acte van dading) from a court (judge) which has the same position as a court decision with permanent legal force or in the legal term is also called incraht van gewijsde. However, if the agreement is under hand there is no legal certainty. Recommendations: 1)To policy makers that if a revision is made to Act Number 22 of 2009 concerning Traffic and Road Transportation, arrangements are made for the settlement of traffic accidents through restorative justice. 2)To the perpetrators and victims of traffic accidents in making peace, preferably through a court (judge).
