Abstract

ABSTRAK Artikel ini bertujuan untuk mengetahui kebijakan pidana kerja sosial sebagai solusi untuk mengurangi kelebihan kapasitas di Lembaga Pemasyarakatan, dan mengetahui bentuk ideal dari pidana kerja sosial yang dapat diterapkan di Indonesia. Penelitian ini dilatarbelakangi karena adanya fenomena kelebihan kapasitas di sejumlah Lembaga Pemasyarakatan di Indonesia yang kemudian menimbulkan banyak konflik baru. Penelitian ini menggunakan pendekatan yuridis normatif, yaitu penelitian yang dilakukan dengan cara mengkaji peraturan-peraturan terkait pidana kerja sosial dan bagaimana bentuk ideal yang dapat diterapkan di Indonesia. Hasil penelitian yang dilakukan penulis adalah pidana kerja sosial memenuhi tujuan pemidanaan yang berlaku dan dapat dijadikan sebagai solusi untuk mengurangi lonjakan jumlah LAPAS yang mengalami kelebihan kapasitas sehingga dapat disimpulkan bahwa pidana kerja sosial cukup relevan untuk diterapkan di Indonesia namun formulasi pidana kerja sosial yang ada masih perlu pengaturan yang lebih rinci agar dapat terlaksana dengan baik. ABSTRACT This article aims to find out Community Service Order policy as a solution to reduce excess capacity in prisons, and to find out the ideal form of social work crime that can be applied in Indonesia. This research is motivated by the phenomenon of excess capacity in many correctional institutions in Indonesia which then causes many new conflicts. This study uses a normative juridical approach, namely research conducted by examining regulations related to social work crimes and how the ideal form can be applied in Indonesia. The results of the research carried out by the author are that social work crimes meet the applicable sentencing objectives and can be used as a solution to reduce the surge in the number of prisons experiencing excess capacity so that it can be concluded that social work crimes are quite relevant to be applied in Indonesia but the existing formulation of social work crimes still needs to be done. more detailed arrangements to be carried out properly.
