Abstract

Penelitian ini bertujuan untuk menjelaskan bagaimana kantor BPN Batanghari menyelesaikan sengeketa Tanah melalui mediasi dan apa saja yang menjadi kendala dari kantor BPN Batanghari dalam menyelesaikan Sengketa. Hasil penelitian menunjukan bahwa penyelesaian sengketa pertanahan melalui mediasi pada Kantor BPN Kabupaten Batanghari sebagian aturan mengenai mediasi sudah diterapkan, namun ada sebagian lain yang belum sesuai dengan aturan, yaitu: pertama, ketentuan Pasal 38 ayat (2) PM ATR/KBPN Nomor 11 tahun 2016 yang menyatakan bahwa pelaksanaan mediasi paling lama 30 (tiga puluh) hari. Pada pelaksanaannya mediasi lebih dari 30 (tiga puluh) hari. Kedua, Pasal 39 ayat (1) PM ATR/KBPN Nomor 11 tahun 2016 yang mengatur tentang peserta mediasi terdiri dari: tim pengolah, pejabat Kementerian, mediator, para pihak dan pakar atau ahli yang terkait. Dalam pelaksanaannya peserta mediasi cukup terdiri dari mediator dan para pihak, pakar atau ahli terkait dapat pula dihadirkan apabila diperlukan. faktor penghambat dalam penyelesaian sengketa pertanahan melalui mediasi yaitu: pihak yang tidak beriktikat baik memanfaatkan proses mediasi sebagai cara untuk mengulur- ulurkan waktu, ketidak jujuran dalam menyelesaikan sengketa, rendahnya tingkat partisipasi pihak yang bersengketa dalam menyelesaikan sengketa tanah, kurangnya Sumber Daya Manusia di kantor pertanahan, masih kurangnya tenaga mediator dan tidak ada sanksi yang tegas dari pihak BPN apabila terjadi kesengajaan salah satu pihak yang bersengketa menghambat proses mediasi. This study aims to explain how the Batanghari BPN office resolves land disputes through mediation and what are the obstacles for the Batanghari BPN office in resolving the Dispute. The results showed that the settlement of land disputes through mediation at the Batanghari Regency BPN Office some of the rules regarding mediation had been applied, but there were others that were not in accordance with the rules, namely: first, the provisions of Article 38 paragraph (2) PM ATR/KBPN Number 11 of 2016 which stipulates that the implementation of mediation is a maximum of 30 (thirty) days. In practice the mediation is more than 30 (thirty) days. Second, Article 39 paragraph (1) of PM ATR/KBPN Number 11 of 2016 which regulates mediation participants consists of: processing teams, Ministry officials, mediators, related parties and experts or experts. In its implementation, the mediation participants consist of a mediator and the parties, experts or related experts can also be presented if needed. inhibiting factors in resolving land disputes through mediation, namely: parties who do not have good intentions using the mediation process as a way to buy time, dishonesty in resolving disputes, low level of participation of disputing parties in resolving land disputes, lack of human resources in the land office , there is still a lack of mediators and no strict sanctions from the BPN in the event that one of the disputing parties intentionally hinders the mediation process.
