Abstract
This study confirmed and emphasized that the act of extrajudicial killing is the jurisdiction of the International Criminal Court (ICC) and whether Rodrigo R Duterte is the supreme leader in the Philippines can be prosecuted before the ICC. This thesis uses juridicial-normative research with statues approach, historical approach, and conceptual approach. Extrajudicial killing is a violation of human right, namely the right to life as regulated in the Universal Declaration of Human Rights and other related conventions. Rome Statute which underlies the establishment of the ICC, allows individuals to be held accountable for a crime in accordance with the jurisdiction of the ICC. Based on the results, extrajudicial killing became the jurisdiction of the ICC based on Article 7 paragraph 1 of the Rome Statute on Crimes against humanity in the Murder section. President Duterte can be sued before the ICC because President Duterte is aware of the policy and is the personal jurisdiction of the ICC. This jurisdiction does not look at whether the individual is a state official or not. Keyword: Extrajudicial Killing, Rome Statute, International Criminal Court
