Abstract

Tindakan kebiri kimia merupakan sanksi tambahan yang dapat di jatuhkan kepada pelaku kejahatan seksual pada anak yang di terapkan di Indonesia melalui Undang-Undang Nomor 17 Tahun 2016 Tentang Perubahan Kedua Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak yang termuat dalam Pasal 81 Ayat (7), yang tata cara pelaksanaannya di atur dalam PP Nomor 70 Tahun 2016. Kebiri kimia di anggap sebagai bentuk sanksi yang kejam dan bertentangan dengan HAM, hal ini karena Indonesia telah meratifikasi Konvensi anti penyiksaan atau hukuman lain yang kejam. Tindakan ini juga di anggap merendahkan harkat dan martabat manusia sebagai manusia seutuhnya yang seharusnya di lindungi, di hormati dan di junjung tinggi oleh Negara dan Pemerintahan. Namun Sebenarnya jika di kaji lebih lanjut kebiri kimia tidak serta merta mencoreng HAM yang di miliki pelaku yang sejatinya ia juga telah merenggut Hak anak yang semestinya pun harus di lindungi, sehingga kebiri kimia ini merupakan suatu bentuk sanksi yang di nilai mampu memberikan efek jera bagi pelaku sekaligus menjadi upaya perlindungan yang komprehensif bagi Anak agar tidak menjadi korban selanjutnya. Hal ini juga sejalan dengan tujuan pemidanaan di Indonesia yang tentunya dalam pelaksaannya kebiri kimia harus memenuhi syarat-syarat untuk di jatuhkan dan di laksanakan dengan tata cara yang termuat dalam Undang-Undang. Kata kunci : Kejahatan Seksual, Kebiri Kimia, HAM, Perlindungan anak. ABSTRACT Castration is an additional sanction that can be imposed on perpetrators of sexual crimes against children which is implemented in Indonesia through Law Number 17 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection as contained in Article 81 Paragraph ( 7) , whose implementation procedure is regulated in PP No. 70 of 2016. Chemical castration is considered a form of cruel sanctions and is Contrary to human rights, this is because Indonesia has ratified the Convention against Torture or other cruel punishments. This action is also considered to be degrading human dignity as a complete human being that should be protected, respected and upheld by the State and Government. If further examined chemical castration does not necessarily tarnish the human rights of the perpetrators who in fact have also taken away the rights of children which should also be protected, so that chemical castration is a form of sanctions which is considered capable of providing a deterrent effect to the perpetrators as well as being a deterrent. Comprehensive protection efforts for children so as not to become the next victim. This is also in line with the purpose of punishment in Indonesia which of course in the implementation of chemical castration must meet the requirements to be dropped and carried out with the procedures contained in the Act.
