Abstract

Penelitian ini dilatarbelakangi oleh beberapa fenomena yang terjadi di lingkungan pemerintahan Sekretariat Daerah Kabupaten Muaro Jambi dimana banyaknya terjadi pelanggaran terhadap disiplin hari dan jam kerja. Hukuman sanksi administrasi yang diberikan nyatanya tidak sesuai dengan Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil. Sementara itu, hukuman administrasi yang diberikan oleh Pemerintah Daerah diatur dalam Peraturan Bupati Muaro Jambi Nomor 116 Tahun 2018 tentang Ketentuan Hari dan Jam Kerja di Lingkungan Pemerintah Kabupaten Muaro Jambi dan Peraturan Bupati Nomor 81 Tahun 2021 tentang Perubahan Atas Peraturan Bupati Nomor 116 Tahun 2018 tentang Ketentuan Hari dan Jam Kerja di Lingkungan Pemerintah Kabupaten Muaro Jambi. Tujuan penelitian ini adalah untuk mengetahui bagaimana penegakan hukum administrasi terhadap pelanggaran disiplin dan apa faktor penyebab terjadinya pelanggaran disiplin pada Pegawai Negeri Sipil (PNS) di Sekretariat Daerah Kabupaten Muaro Jambi. Tipe penelitian yang digunakan adalah yuridis empiris dan alat pengumpulan data melalui wawancara dan studi dokumen dimana data yang diperoleh dari bahan pustaka serta literatur ilmiah. Hasil penelitian menunjukkan bahwa penegakan hukum administrasi PNS di Sekretariat Daerah Kabupaten Muaro Jambi belum maksimal karena beberapa pegawai yang melakukan pelanggaran disiplin absensi tidak ditindak sesuai dengan Peraturan Pemerintah Nomor 91 Tahun 2021. Dalam hal pengawasan preventif dan represif sudah dilakukan. Adapun beberapa faktor penyebab terjadinya ketidakdisiplinan yaitu banyaknya pegawai yang berasal daeri daerah luar Kabupaten Muaro Jambi sehingga banyak pegawai yang terlambat, kurangnya monitoring (pengawasan) masing-masing Kepala Bagian kepada staffnya terutama yang melanggar disiplin, kecilnya jumlah tunjangan (TPP) serta sering terlambatnya pencairan TPP di Pemerintah Kabupaten Muaro Jambi, tidak ada reward atau penghargaan berupa tambahan penghasilan bagi pegawai yang lembur atau berprestasi karena selama ini reward yang diberikan hanya berupa piagam penghargaan dan sistem aplikasi absensi online (SIKO) Muaro Jambi yang tidak bisa digunakan sehingga OPD melakukan absen melalui finger print maupun absen manual (tanda tangan di form absensi). Kata Kunci: Disiplin, Penegakan, Pelanggaran, Pegawai Negeri Sipil, Hukum Administrasi This research is motivated by several phenomena that occur in the government environment of the Regional Secretariat of Muaro Jambi Regency where there are many violations of discipline on working days and hours. The administrative sanctions given were in fact not in accordance with Government Regulation Number 94 of 2021 concerning Discipline for Civil Servants. Meanwhile, the administrative punishment given by the Regional Government is regulated in Muaro Jambi Regent Regulation Number 116 of 2018 concerning Provisions for Working Days and Hours within the Muaro Jambi Regency Government and Regent Regulation Number 81 of 2021 concerning Amendments to Regent Regulation Number 116 of 2018 concerning Provisions Working Days and Hours in the Government of Muaro Jambi Regency. The purpose of this study was to find out how administrative law enforcement is against disciplinary violations and what are the factors causing disciplinary violations in Civil Servants (PNS) at the Regional Secretariat of Muaro Jambi Regency. The type of research used is empirical juridical and data collection tools through interviews and document studies where the data obtained from library materials and scientific literature. The results showed that law enforcement for civil servant administration at the Regional Secretariat of Muaro Jambi Regency was not maximized because several employees who committed absentee disciplinary violations were not prosecuted in accordance with Government Regulation Number 91 of 2021. In terms of preventive and repressive supervision, they have been carried out. There are several factors that cause indiscipline, namely the large number of employees who come from areas outside Muaro Jambi Regency so that many employees are late, the lack of monitoring (supervision) of each Head of Section for his staff, especially those who violate discipline, the small amount of allowances (TPP) and frequent delays in disbursement TPP in the Muaro Jambi Regency Government, there are no rewards or awards in the form of additional income for employees who work overtime or achieve because so far the rewards given are only in the form of award certificates and the Muaro Jambi online attendance application system (SIKO) which cannot be used so that the OPD takes absences through finger print or manual absence (signature on the attendance form).
