Abstract

ABSTRAK Tujuan dalam penelitian ini adalah 1) untuk mengetahui dan mendeskripsikan bentuk perlindungan hak bagi penyandang disabilitas unntuk memperoleh pendidikkan di Indonesia; dan 2) untuk mengetahui mendeskripsikanpelaksanaan perlindungan hak bagi penyandang disabilitas untuk memperoleh pendidikkan di Indonesia sesuai dengan Convention on the Rights of Persons With Disabilities. Penelitian ini merupakan penelitian normative yaitu bersifat preskriptifdengan analisis data secara deskriptif. Hasil dari pembahasan bahwa Bentuk perlindungan hak bagi penyandang disabilitas untuk memperoleh pendidikkan di Indonesia belum sesuai dengan Convention on the Rights of Persons With Disabilities karena masih adanya pembedaan akses pendidikan bagi penyandang disabilitas di Indonesia. Implementasi perlindungan hak bagi penyandang disabilitas untuk memperoleh pendidikkan di Indonesia dilakukan dengan cara melaksanakan pendidikan inklusif dan menyediakan sarana pendidikan khusus bagi penyandang disabilitas yang telah diatur dalam Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas, Undang-Undang Nomor 20 Tahun 2003 tentang Sistem Pendidikan Nasional, Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia, serta Peraturan Menteri Pendidikan Nomor 70 Tahun 2009 tentang Pendidikan Inklusif. Kata Kunci : hak pendidikan, penyandang disabilitas ABSTRACT The aims of this research are 1) to find out and describe the forms of protection for the rights of persons with disabilities to obtain education in Indonesia; and 2) to find out how to describe the implementation of the protection of the rights of persons with disabilities to obtain education in Indonesia in accordance with the Convention on the Rights of Persons With Disabilities. This research is a normative research that is prescriptive with descriptive data analysis. The results of the discussion are that the form of protecting the rights of persons with disabilities to obtain education in Indonesia is not in accordance with the Convention on the Rights of Persons With Disabilities because there are still differences in access to education for persons with disabilities in Indonesia. The implementation of protecting the rights of persons with disabilities to obtain education in Indonesia is carried out by implementing inclusive education and providing special educational facilities for persons with disabilities as regulated in Law Number 8 of 2016 concerning Persons with Disabilities, Law Number 20 of 2003 concerning the Education System National, Law Number 39 of 1999 concerning Human Rights, and Minister of Education Regulation Number 70 of 2009 concerning Inclusive Education.
