Abstract

ABSTRAK Tulisan ini membahas kebijakan Countering America’s Adversaries Through Sanctions Act (CAATSA) yang diterapkan oleh Amerika Serikat terhadap negara- negara yang melakukan pembelanjaan militer dengan Rusia, Iran, dan Korea Utara. Kebijakan CAATSA yang berbentuk sanksi embargo ini penting untuk ditelaah melalui berbagai perspektif ilmiah karena merupakan kebijakan sanksi ekonomi pertama Amerika yang diterapkan secara kolektif. Berbeda dengan sanksi embargo sebelumnya yang diaplikasikan secara personal terhadap suatu Negara dengan alasan tertentu, CAATSA ditujukan terhadap semua negara kendati padakataannya terdapat pengecualian. Meskipun penelitian mengenai CAATSA ini tidak banyak dilakukan, namun demikian sebagian besar kajian terdahulu lebih banyak melihat dengan sudut pandang hubungan Amerika-Rusia ,Hukum penegakan sanksi embargo, proses pembuatan kebijakan Amerika, dampak dari adanya sanksi embargo. Dengan menggunakan sudut pandang hukum Internasional sebagai kerangka analisis, tulisan ini membingkai dampak dari pelaksanaan kebijakan CAATSA terhadap Negara-negara diluar Amerika Serikat. Argumen utama dalam tulisan ini adalah bagaimana hukum dalam negeri Amerika Serikat berdampak luar negeri tidak bisa diterapkan secara kolektif karena akan bertabrakan dengan kepentingan lain yang lebih besar,serta membuat penerapan menjadi tidak efektif karena adanya pengecualian terhadap beberapa negara. Kata Kunci :Yuridiksi Ektrateritorial;CAATSA. ABSTRACT This paper discusses the policy of Countering America's Adversaries Through. The Sanctions Act (CAATSA) was imposed by the United States on countries that do military spending with Russia, Iran, and North Korea CAATSA policy in the form of an embargo sanction is important to studied through various scientific perspectives because it is a policy of sanctions America's first collectively implemented economy. Unlike the previous embargo sanctions that were applied personally to a country for certain reasons, CAATSA is aimed at all countries although in fact there are exceptions. Although not much research has been done on CAATSA, most of the previous studies have looked at the point of view of the US-Russia relationship, the law on the enforcement of sanctions embargoes, the American policy-making process, and the impact of the sanctions embargo. Using an international law perspective as an analytical framework, this paper frames the impact of implementing CAATSA policies on countries outside the United States. The main argument in this paper is how the United States' domestic law has a foreign impact that cannot be applied collectively because it will collide with other, larger interests, and make its implementation ineffective due to exceptions to several countries.
