Abstract

ABSTRAK Skripsi ini bertujuan untuk mengetahui dan memahami tentang perlindungan hukum terhadap korban atas hak Restitusi dalam tindak pidana perdagangan orang. Permasalahan dalam penulisan ini adalah 1) Bagaimana pengaturan hukum terhadap korban mengenai Hak Restitusi dalam Tindak Pidana Perdagangan Orang dan 2) Bagaiamana perspektif kedepannya terhadap korban menganai Hak Restitusi dalam Tindak Pidana Perdagangan Orang. Adapun metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yaitu penelitian yang diperoleh dari studi kepustakaan, dengan menganalisa suatu permasalahan hukum melalui pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus. Penelitian dilakukan dengan mengumpulkan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian ini ialah bahwa kurangnya upaya yang maksimal dari penegak hukum dalam pemenuhan hak Restitusi terhadap korban. Hal ini dikarenakan belum tersedianya petunjuk pelaksanaan Restitusi pada Pasal 40 sampai 50 UU Pemberantasan Tindak Pidana Perdagangan Orang. Pelaku tindak pidana perdagangan orang seringkali menghindar untuk memberikan Restitusi, bahkan bersikap seolah-olah tidak memiliki harta apapun yang diperoleh dari bisnis perdagangan orang tersebut. Untuk menghindari penolakan pembayaran Restitusi kepada korban perdagangan orang, perlu dilakukan mediasi sejak proses penyidikan. Upaya mendapatkan ganti rugi tersebut dilakukan melalui mediasi penal. Upaya perdamaian melalui mediasi penal tidak akan menghapus tuntutan atas tindak pidana yang terjadi, namun hanya mempermudah penyitaan harta kekayaan yang diperoleh dari hasil dari Tindak Pidana Perdagangan Orang. Kata kunci: Korban, Restitusi,Tindak Pidana Perdagangan Orang. ABSTRACT This thesis aims to know and understand the legal protection of victims of the right of restitution in the crime of trafficking in persons. The problems in this writing are 1) How are the legal arrangements for victims regarding the Right to Restitution in the Crime of Trafficking in Persons and 2) How is the legal protection for victims regarding the Right to Restitution in the Crime of Trafficking in Persons. The research method used in this study is normative juridical research, namely research obtained from literature studies, by analyzing a legal issue through statutory approaches, conceptual approaches, case approaches. The research was conducted by collecting primary legal materials, secondary legal materials and tertiary legal materials. The results of this study are that there is a lack of maximum effort from law enforcers in fulfilling the right of restitution for victims. This is due to the unavailability of instructions for implementing restitution in Articles 40 to 50 of the Law on the Eradication of the Crime of Trafficking in Persons. The perpetrators of the crime of trafficking in persons often avoid giving restitution, even acting as if they do not own any assets obtained from the trafficking business. To avoid refusal to pay restitution to victims of trafficking in persons, it is necessary to carry out mediation since the investigation process. Efforts to obtain compensation are carried out through penal mediation. Peace efforts through penal mediation will not remove charges for the criminal acts that occurred, but only facilitate the confiscation of assets obtained from the proceeds of the Crime of Trafficking in Persons.
