Abstract

The purpose of this study is to find out and analyze regulations against bullying crimes in educational institutions today and to find out and analyze criminal law policies against bullying crimes in educational institutions in the future. The formulation of the problem in this research is 1) how is the current regulation of bullying crimes in educational institutions ? 2) what are the criminal law policies against bullying crimes in educational institutions in the future ? This research is written using a normative juridical research type, which includes the study of legal conflicts, legal vacuum, or ambiguity of norms. This research uses various approaches, including conceptual approach, statutory approach, case approach. The results of the research 1) currently Indonesia does not yet have regulations that specifically regulate the crime of bullying in educational institutions several regulations which is associated with the crime of bullying in educational institutions currently has many weaknesses 2) in the future a renewal of criminal law policies is needed that can become a legal umbrella against bullying crimes in educational institutions as an ius constituendum. In every educational institution it is expected to have strict supervision of acts of bullying because bullying behavior has a very detrimental and dangerous impact on others.
