Abstract

ABSTRACT This study aims to analyze the provision of remission, the formulation of the problem is 1) how is the regulation of giving remission of corrupt convict Demanding Law Number 22 of 2022. 2) what is the mechanism for granting remission to corrupt convict according to law Number 22 of 2022. ini research this study uses the yuridis normative legal research method. Based on the result of the research conducted, it can be seen that, remission is a reduction in the period of serving a sentence given to convict and children who meet the condition specified in the provisions of the law number 22 of 2022 concerning correctional institution, certain requirements as referred to are good behavior, actively participating in coaching programs, and has shown a reduced level of risk. Requirements for obtaining remission for each convict have the same conditions, except for the convict of corruption cases, to obtain remission the minister of law and human rights requires paying in full fines and/or replacement money. One of the condition for obtaining remission is good behavior, this is certainly not enough to provide a deterrent effect for corrupt convict. Then remission consists of several types, namely, general remission, special remission, humanitarian remission, and additional remission. Key Word: Penitentiary, Remission, Convict, Corruptor.
