Abstract

This article discusses carbon trading as a form of market-based mechanism to mitigate and adapt to the impacts of climate change. By referring to the Paris Agreement to the UNFCCC 2015 as an international legal instrument related to carbon trading, it is found that there are no rules that explicitly regulate the global carbon pricing mechanism. This has an impact on unfair market competition, especially between developed and developing countries. In addition, the carbon trading mechanism in the Paris Agreement uses a voluntary cooperation system which also assigns emission reduction targets to each country, making it vulnerable to low state participation in reducing global GHG emissions. This then raises the question: is carbon trading really effective in reducing the pace of global climate change? The research method used in this research is juridical-normative with a statutory and conceptual approach. By conducting a review of the rules and norms related to carbon trading arrangements, it was found that there was legal ambiguity in the current carbon trading regulations, the Paris Agreement 2015. The solution offered was through the establishment of a new international legal instrument that is legally binding for countries. parties and contains provisions regarding the global carbon pricing mechanism.
