Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui dan menganalisis pelaksanaan perjanjian sewa menyewa lahan sawah antara pemilik tanah dengan penyewa dan untuk mengetahui dan menganalisis kendala dalam pelaksanaan perjanjian sewa menyewa lahan sawah di Desa Pasir Putih Kecamatan Muara Sabak Barat Kabupaten Tanjung JabungTimur serta upaya penyelesaiannya. Perumusan masalah ini adalah 1) Bagaimana pelaksanaan perjanjian sewa menyewa lahan sawah antara pemilik tanah dengan penyewa di Desa Pasir Putih Kecamatan Muara Sabak Barat Kabupaten Tanjung JabungTimur; 2) Apa saja kendala dalam pelaksanaan perjanjian sewa menyewa lahan sawah di Desa Pasir Putih Kecamatan Muara Sabak Barat Kabupaten Tanjung JabungTimur serta upaya penyelesaiannya. Metode penelitian ini Yuridis Empiris. Hasil penelitian menyatakan bahwa pelaksanaan perjanjian sewa menyewa lahan sawah di Desa Pasir Putih Kecamatan Muara Sabak Barat Kabupaten Tanjung Jabung Timur belum terlaksana sebagaimana mestinya. Terdapat penyewa yang melakukan wanprestasi dengan melanggar isi surat perjanjian dimana penyewa tidak melunasi sewa sawah dan terlambat membayar sewa sawah. Kendala yang menyebabkan wanprestasi dalam pelaksanaan perjanjian sewa menyewa lahan sawah di Desa Pasir Putih Kecamatan Muara Sabak Barat Kabupaten Tanjung Jabung Timur dikarenakan faktor ekonomi dan hasil panen menurun. Upaya yang dilakukan yakni para pihak melakukan penyelesaian dengan cara musyawarah antara kedua belah pihak. Kata Kunci :Lahan Sawah, Perjanjian Sewa Menyewa ABSTRACT The purpose of this research is to know and analyze the implementation of the lease agreement of paddy field land between the landowner and the tenant and the obstacles in the implementation of the lease agreement of paddy field land in Pasir Putih Village, Muara Sabak Barat Subdistrict, Tanjung JabungTimur Regency and its settlement efforts. The formulation of this problem is 1) How is the implementation of the lease agreement between landowners and tenants in Pasir Putih Village, West Muara Sabak Sub-district, Tanjung Jabung East Regency; 2) What are the obstacles in the implementation of the rice field lease agreement in Pasir Putih Village, Muara Sabak Barat Subdistrict, Tanjung Jabung East Regency and its resolution efforts. This research method is juridical empirical. The results of the study state that the implementation of the rice field lease agreement in Pasir Putih Village, West Muara Sabak District, East Tanjung Jabung Regency has not been implemented properly. There are tenants who make defaults by violating the contents of the agreement letter where there are tenants who do not pay off the rice field rent and are late in paying the rice field rent. The obstacles that cause default in the implementation of a rice field lease agreement in Pasir Putih Village, West Muara Sabak Subdistrict, East Tanjung Jabung Regency are due to economic factors and declining crop yields. The efforts made are that the parties make a settlement by way of deliberation between the two parties. Keywords: Lease Agreement, Paddy Field
