Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis tentang tinjauan yuridis terhadap pidana perkosaan terhadap pria didalam perspektif Kitab Undang-undang Hukum Pidana (KUHP) yang sedang digunakan pada saat ini dan pembentukan hukum terhadap konsep perkosaan di masa mendatang, terkhususnya yang mengatur pidana perkosaan terhadap pria. Rumusan Masalah dalam penelitian ini adalah Bagaimana pengaturan tindak pidana perkosaan diatur di dalam KUHP? dan Bagaimana kebijakan pembaharuan hukum pidana dalam mengatur tentang tindak pidana perkosaan di masa yang akan mendatang? Metode Penelitian yang digunakan didalam penelitian ini adalah Yuridis Normatif yang mempelajari peraturan perundang-undangan yang berkaitan tentang tindak pidana perkosaan terhadap pria didalam perspektif Kitab Undang-undang Hukum Pidana (KUHP) yang sedang digunakan pada saat ini dan pembentukan hukum terhadap konsep perkosaan di masa mendatang dengan menggunakan Pendekatan perundang-undangan (Statuta Approach), Pendekatan konseptual (Conceptual Approach) dan Pendekatan perbandingan (Comparative Approach). Dari hasil penelitian ini telah ditemukan kekosongan hukum terhadap tindak pidana perkosaan yang dilakukan oleh pelaku wanita terhadap korban pria. Konsep perkosaan yang sangat sempit didalam KUHP mengakibatkan banyak konsep-konsep perkosaan yang terjadi tidak dapat dimuat didalah hukum pidana Indonesia saat ini. Dengan demikian, pembaharuan hukum pidana ditawarkan sebagai solusi atas hal tersebut dengan memperluas definisi dan konsep dari perkosaan itu sendiri yang dimuat didalam Undang-undang Nomor 1 Tahun 2023 tentang KUHP dan Kitab Hukum Pidana Negara Prancis yaitu Code Penal France. Kata Kunci : Pembaharuan Hukum Pidana , Perkosaan, Pria ABSTRACT This study aims to analyze the juridical review of the criminal rape of men in the perspective of the Criminal Code of Indonesia (KUHP) that is currently being used and the formation of laws against the concept of rape in the future, especially those governing the criminal rape of men. The formulation of the problem in this study is how is the regulation of the criminal act of rape regulated in the Criminal Code? and How is the policy of reforming the criminal law in regulating the crime of rape in the future? The research method used in this study is Normative Juridical which studies laws and regulations related to the crime of rape against men in the perspective of the Criminal Code of Indonesia (KUHP) that is currently in use and the formation of laws against the concept of rape in the future by using statutory approach (Statutes Approach), conceptual approach (Conceptual Approach) and comparative approach (Comparative Approach). From the results of this study, a legal vacuum has been found regarding the crime of rape committed by female perpetrators against male victims. The very narrow concept of rape in the Criminal Code of Indonesia resulted in many of the concepts of rape that occurred that cannot be contained in the current Indonesian criminal law. Thus, reforming the criminal law is offered as a solution to this by expanding the definition and concept of rape itself contained in Law Number 1 of 2023 concerning the Criminal Code and the French Criminal Code, namely the French Penal Code.
