Abstract

This study aims to determine the punishment for the perpetrators of the beatings which resulted in the victim being seriously injured, the formulation of the problem is (1). how to set punishment against the perpetrator of the beating which resulted in the victim being seriously injured (Decision of the Padang District Court Number 758/pid.b/2022/pn Pdg) (Decision of the Padang District Court Number 757/pid.b/2022/pn Pdg), (2). how the punishment against the perpetrator of the beating which resulted in the victim being seriously injured (Decision of the Padang District Court Number 758/pid.b/2022/pn Pdg) (Decision of the Padang District Court Number 757/pid.b/2022/pn Pdg),In this study, normative juridical research was used based on the results of the research conducted that the criminal arrangements for the perpetrators of the beatings resulted in the victim experiencingSerious injury is contained in Article 354 of the Criminal Code of the persecution of Jo article 55 of the Criminal Code, and it can be seen that the case of the judge's decision here was not quite right where the main perpetrator was given the same decision, namely8 years each and some 7 years should be distinguished considering he is the main actor who has an important role in this beating case so it must be heavier than the perpetrators anotherculprit.
