Abstract

Persaingan produk reksadana membuat manajer investasi melakukan kecurangan dalam menawarkan produk reksadananya dengan menjanjikan keuntungan pasti. Akibatnya terjadi pembubaran reksadana atas perintah dari OJK karena telah melakukan pelanggaran dalam aturan pemasaran produk reksadana. Tujuan penelitian ini untuk mengetahui dan menganalisa perlindungan hukum yang didapatkan investor reksa dana dalam pasar modal menurut peraturan perundang-undangan. serta mengetahui bagaimana tanggung jawab dari pihak manajer investasi terhadap investor reksa dana yang mengalami kerugian. Jenis penelitian yang digunakan dalam tugas akhir ini yaitu Yuridis Normatif dikarenakan terjadinya konflik norma antara peraturan OJK No.23 Tahun 2016 tentang reksa dana KIK pasal 55 dan UUPM yang mana OJK berwenang untuk membubarkan reksa dana berbentuk KIK. Yang mana jika dilihat dari dampak peristiwa yang terjadi pembubaran reksa dana membuat para investor kehilangan dananya, sehingga membuat tidak sesuai dengan UUPM yang memberikan hak kepada investor agar mendapatkan haknya untuk menebus unit penyertaan. menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. upaya preventif diatur dalam Pasal 65 peraturan OJK tentang reksa dana KIK dan upaya perlindungan represif yaitu dengan penegakan sanksi. Namun, dari segi regulasi yang ada yaitu diperlukan pengaturan yang spesifik mengenai larangan pemasaran produk reksa dana. Serta sanksi yang tegas terhadap persoalan gagal bayar terhadap investor. Dan bentuk pertanggungjawaban hukum manajer investasi bertindak sebagai pihak likuidator produk reksadana yang dikelolanuya. Hasil dari likuidasi reksadana dibagikan kepada para investor reksadana secara proporsional sesuai dengan kepemilikan. This research project aims to analyze the legal protection available to mutual fund investors in the capital market and the responsibilities of investment managers in cases of investor losses. The study utilizes a Normative Juridical research approach to address conflicts between OJK regulation No. 23 of 2016 and the UUPM (Capital Market Law) regarding the dissolution of mutual funds. The research examines the rights of mutual fund investors to redeem participation units and the inconsistencies that arise when investors lose their funds due to mutual fund disbandment. The statutory approach, conceptual approach, and case approach are used to analyze the legal framework. Preventive measures, outlined in Article 65 of the OJK regulations for KIK mutual funds, focus on regulating marketing practices. Repressive protection measures involve enforcing sanctions. However, specific provisions are needed to prohibit fraudulent marketing of mutual fund products and to establish strict sanctions for defaulting on investor rights. The research also explores the legal responsibility of investment managers acting as liquidators for the mutual funds they manage. In cases of mutual fund liquidation, the proceeds should be distributed proportionally to mutual fund investors based on ownership. In summary, this research project seeks to analyze the legal protection available to mutual fund investors, propose necessary reforms to address regulatory gaps, and determine the responsibilities of investment managers.
