Abstract

This study aims to examine the characteristics of the principle of proportionality in the terms and conditions between PT Shopee Indonesia and Shopeefood's driver partners and to provide a legal construction in electronic contracts that reflects the principle of proportionality. This study uses a normative juridical research method that is evaluative. The type of data used is secondary data, which includes primary and secondary legal materials. While the technique of collecting legal materials used in analyzing these problems uses library research techniques, which are then carried out by analytical techniques using the deductive method, The results of the study show that the general terms and conditions contained in the electronic contract between PT Shopee Indonesia and Shopeefood Driver Partners have not demonstrated the application of the principle of proportionality. The application of the principle of proportionality in electronic contract standards is an ideal solution for weighing the rights and obligations between the parties so as to minimize the occurrence of risks while still creating the principles of mutual need, strengthening, and benefit.
