Abstract

Penelitian ini bertujuan untuk mengetahui apakah pengaturan mengenai restitusi sudah memberikan perlindungan dan kepastian hukum bagi anak korban kekerasan seksual. Jika diteliti UU 31/2014, UU 35/ 2014, PP 7/2018, dan PP 43/2017, tidak mengatur sanksi bagi pelaku jika tidak melaksanakan kewajibannya berupa pemberian restitusi, ini membuat upaya perlindungan korban kembali melemah. Penelitian ini menggunakan metode penelitian normative yang didukung oleh peraturan Perundang-Undangan. Hasil studi ini menunjukan jika pengaturan mengenai restitusi belum memberikan perlindungan sepenuhnya terhadap korban, karena kekosongan norma. Berdasarkan hasil penelitian tersebut, penulis memiliki saran yaitu, pemerintah perlu merevisi peraturan terkait restitusi agar pelaksanaannya memiliki mekanisme serta sanksi yang jelas. Kata Kunci: Kekerasan Seksual, Perlindungan Anak, Restitusi. This study aims to find out whether the regulation regarding restitution has provided protection and legal certainty for child victims of sexual violence. If we examine Law 31/2014, Law 35/2014, PP 7/2018, and PP 43/2017, they do not stipulate sanctions for perpetrators if they do not carry out their obligations in the form of granting restitution, this weakens efforts to protect victims again. This research uses normative research methods supported by laws and regulations. The results of this study indicate that arrangements regarding restitution have not provided full protection for victims, due to the absence of norms. Based on the results of this study, the authors have a suggestion that the government needs to revise regulations related to restitution so that the implementation has clear mechanisms and sanctions.
