Abstract
ABSTRAK Penelitian ini dilatarbelakangi Undang-undang Jaminan Produk Halal pada Pasal 4 Produk yang masuk, beredar dan diperdagangkan di wilayah Indonesia wajib disertifikasi halal. Menjadi pembahasan dalam skripsi ini, Bagaimana konsep dari produk Usaha Mikro Kecil Dan Menengah (UMKM)? Bagaimana seharusnya pengaturan sertifikasi halal terhadap produk Usaha Mikro Kecil Dan Menengah (UMKM)?. bagaimana pertanggungjawaban negara terhadap sertifikasi halal untuk produk Usaha Mikro Kecil Dan Menengah (UMKM)?, Penelitian ini merupakan menggunakan metode penelitian Yuridis Normatif yaitu melakukan penelitian dengan mengalisis asas-asas dan norma-norma hukum. Dalam menganalisis permasalahan dalam penelitian ini digunakan teori Perlindungan Hukum menurut Philipus M. Hadjon Dan teori kepastian hukum menurut Utrecht, Setelah dianalisis maka skripsi ini menyimpulkan, pengaturan sertifikat halal dan tanggung jawab negara bagi sertifikasi halal terhadap produk Usaha Mikro Kecil Dan Menengah (UMKM) negara telah memfasilitasi sebagai tanggung jawab negara dengan melahirkan Undang-undang Nomor 33 Tahun 2014 Tentang Jaminan Produk Halal dengan cara mewajibkan seluruh produk yang beredar diwilayah Indonesia wajib disertifikasi dan labelisasi, untuk produk Usaha Mikro Kecil dan menengah (UMKM) namun masih belum memiliki sanksi atau tanggungjawab yang jelas Kata Kunci : Perlindungan Hukum, Konsumen, Usaha Mikro Kecil dan Menengah ABSTRACT This research is motivated by the Halal Product Assurance Law in Article 4 Products that enter, circulate and trade in the territory of Indonesia must be halal certified. As a discussion in this thesis, what are the regulations and state responsibilities for halal certification for Micro, Small and Medium Enterprises (MSMEs) products?, What is the concept of Micro, Small and Medium Enterprises (MSMEs) products? How should the regulation of halal certification for Micro, Small and Medium Enterprises (MSMEs) products? This research uses the Normative Juridical research method, namely conducting research by analyzing legal principles and norms, well, analyzing what is written in the law, by exploring principles and norms, the data sources used are data sources. secondary. In analyzing the problems in this study, the theory of Legal Protection according to Philipus M. Hadjon and the theory of legal certainty according to Utrecht are used, to analyze the issue of how halal certification should be regulated for Micro, Small and Medium Enterprises (MSMEs) products in Indonesia.
