Abstract

Tujuan penelitian ini ialah untuk mengetahui bagaimana Proses Pengalihan Aset dari Kabupaten Kerinci ke Kota Sungai Penuh Pasca Pemekaran. Dengan rumusan masalah terdiri dari dua permasalahan yang pertama, bagaimana proses pelaksanaan penyerahan aset dari Pemerintah Kabupaten Kerinci ke Pemerintah Kota Sungai Penuh. Kedua, bagaimana upaya yang telah dilakukan pemerintah Kota Sungai Penuh dalam rangka proses percepatan penyerahan Aset dari Pemerintah Kabupaten Kerinci ke Pemerintah Kota Sungai Penuh. Metode penelitian ini menggunakan metode yuridis empiris yaitu yang melalui wawancara dan pengamatan langsung. Penyerahan aset dari Kabupaten Kerinci ke Kota Sungai Penuh berdasarkan Undang-Undang Nomor 25 Tahun 2008 Tentang Pembentukan Kota Sungai Penuh dilakukan dalam jangka waktu (5) Tahun dari diresmikan. Itu artinya penyerahan aset harus dilakukan sejak tahun 2009 dan harus sudah selesai pada tahun 2014. Namun pada faktanya penyerahan aset belum juga selesai sampai pada tahun 2020. Persoalan mengenai aset daerah tersebut, telah dilakukan upaya konsensus dari Pemerintah Kabupaten Kerinci dan Kota Sungaipenuh, akan tetapi upaya tersebut tetap tidak dapat diselesaikan antara kedua Pemerintah Daerah tersebut dikarenakan tingkatan antara kedua pemerintah daerah tersebut mempunyai tugas dan kewenangan yang sama dalam penguruasan wilayah/daerahnya masing-masing , sehingga belum ditemukannya kesepakatan bersama antara kedua Pemerintahan Daerah tersebut, hal ini tentunya menjadi suatu permasalahan serius antara Pemerintah Daerah tersebut yang harus diselesaikan. The purpose of this study was to find out how the process of transferring assets from Kerinci Regency to Sungai Penuh City after the expansion. With the formulation of the problem consisting of the first two problems, what is the process for implementing the handover of assets from the Kerinci District Government to the City Government of Sungai Penuh. Second, what are the efforts that have been made by the City of Sungai Penuh Government in the context of accelerating the process of disbursing assets from the Government of Kerinci Regency to the City Government of Sungai Penuh. This research method uses empirical juridical methods, namely through interviews and direct observation. The handover of assets from Kerinci Regency to Sungai Penuh City based on Law Number 25 of 2008 concerning the Establishment of Sungai Penuh City was carried out within (5) years of being inaugurated. That means that the transfer of assets must have been carried out since 2009 and must have been completed in 2014. However, in reality the transfer of assets has not been completed until 2020. The issue regarding the regional assets, has been carried out in the context of efforts from the Government of Kerinci Regency and Sungai Penuh City, however these efforts still cannot be resolved between the two Regional Governments because the levels between the two regional governments have the same duties and authority in managing their respective regions, so that mutual agreement has not been found between the two Regional Governments, this is certainly a problem between the Regional Governments that must be resolved.
