Abstract

ABSTRAK Target yang tidak tercapai tentunya mempunyai kendala baik di Kantor Pertanahan Nasional kabupaten Kerinci maupun di dalam masyarakat itu sendiri. Program Sertipikat Hak Atas Tanah bagi UMKM ini tidak dipungut biaya sepersen pun atau gratis. Akan tetapi masih banyak masyarakat yang tidak ikut dalam program yang telah di buat oleh pemerintah, padahal kebijakan yang dikeluarkan pemerintah melalui program sertipikat hak atas tanah bagi UMKM sangat menguntungkan para usaha Mikro dan Kecil tersebut. Penelitian ini bertujuan untuk mengetahui pelaksanaan program pendaftaran sertipikat hak atas tanah usaha mikro dan kecil di Badan Pertanahan Nasional Kabupaten Kerinci. Adapun rumusan masalah dalam penelitian ini adalah (1) Bagaimakah pelaksanaan pendaftaran program sertipikasi hak atas tanah usaha mikro dan kecil di Kabupaten Kerinci?. (2) Apa saja strategi Badan Pertanahan Nasional kabupaten Kerinci dalam pelaksanaan program sertipikasi hak atas tanah usaha mikro dan kecil di Kabupaten Kerinci?. Jenis penelitian ini bersifat yuridis empiris, pengumpulan data dilakukan dengan prosedur studi kepustakaan (library research). Hasil penelitian ini menyatakan bahwa implementasi penerapan Good Goverment dalam kinerja Badan Pertanahan Nasional di Kabupaten Kerinci berdasarkan Peraturan Pemerintah Nomor 18 tahun 2021 tentang pendaftaran tanah dapat diukur melalui unsur produktifitas, responsifitas dan akuntabilitas. Pada unsur produktifitas dan akuntabilitas, penerapan Good Goverment dalam kinerja Badan Pertanahan Nasional di Kabupaten Kerinci dapat dikatakan masih belum sepenuhnya sesuai dengan Undang-undang nomor 25 Tahun 2009 tentang Pelayanan Publik. Berdasarkan penelitian yang dilakukan terdapat kekurangan yaitu pada unsur responsifitas. Pelakasanaan kinerja BPN Kabupaten Kerinci masih memiliki sikap yang kurang responsif terhadap pihak yang mengajukan perizinan pertanahan. Pelaksanaan Program Sertifikasi Hak Atas Tanah Usaha Mikro dan Kecil bertujuan untuk memberikan bantuan kepada pemilik usaha mikro dan kecil yang belum mempunyai sertifikat tanah dan memiliki kesulitan dalam akses permodalan perbankan. Dalam pelaksanaannya, teknis-teknis dalam pelaksanaan program telah dilaksanakan sesuai dengan petunjuk teknis yang telah ditetapkan. Meskipun hasil pelaksanaan program, tidak seluruh usaha mikro dan kecil yang merupakan peserta pro-gram menggunakan sertifikat tanahnya sebagai alat jaminan permodalan. Meskipun pelaksanaan program sertifikasi hak atas tanah di Kabupaten Kerinci cukup lancar, terdapat beberapa faktor-faktor yang mendukung maupun sedikit menghambat Kata Kunci: Pelaksanaan, Pendaftaran, Sertipikat ABSTRACT Targets that are not achieved certainly have obstacles both in the National Land Office of Kerinci district and within the community itself. However, there are still many people who do not participate in the programs that have been made by the government, even though the policies issued by the government through the land rights certificate program for MSMEs are very beneficial to these Micro and Small Enterprises. This study aims to determine the implementation of the registration program for micro and small business land rights certificates at the Badan Pertanahan Nasional Kabupaten Kerinci. The formulation of the problem in this study is (1) How is the registration of the micro and small business land rights certification program in Kerinci Regency?. (2) What are the strategies of the Badan Pertanahan Nasional Kabupaten Kerinci in implementing the certification program for land rights of micro and small enterprises in Kerinci district? This type of research is empirical juridical, data collection is carried out by library research procedures. The results of this study state that the implementation of Good Government implementation in the performance of the National Land Agency in Kerinci Regency based on Government Regulation Number 24 of 1997 concerning land registration can be measured through elements of productivity, responsiveness and accountability. In the elements of productivity and accountability, the implementation of Good Government in the performance of the National Land Agency in Kerinci Regency can be said to be still not fully in accordance with Law number 25 of 2009 concerning Public Services. Based on the research conducted, there are shortcomings, namely in the element of responsiveness. The performance of BPN Kerinci Regency still has a less responsive attitude towards those who apply for land permits. The implementation of the Micro and Small Business Land Rights Certification Program aims to provide assistance to micro and small business owners who do not have land certificates and have difficulties in accessing banking capital. In its implementation, the technicalities in the implementation of the program have been carried out in accordance with the technical guidelines that have been set. Despite the results of the program implementation, not all micro and small enterprises that are participants in the program use their land certificates as a means of capital guarantee. Although the implementation of the land rights certification program in Kerinci Regency is quite smooth, there are several factors that support or slightly hinder.
