Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis sistem penentuan orisinalitas pada platform Youtube dan Perlindungan hukum terhadap pencipta video Youtube atas tindakan unggah ulang tanpa mencantumkan sumber pencipta. Jenis penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum yuridis normatif dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini menunjukan bahwa dalam pengaturan kebijakan Youtube orang pertama yang mengunggah video dianggap sebagai pencipta video tersebut. jadi orisinalitas atau keaslian suatu video dilihat dari orang yang pertama kali mengunggah video ke Youtube. Untuk menangani tindakan video Youtube yang diunggah ulang oleh channel Youtube orang lain aturan kebijakan Youtube memiliki Copyright Match Tool dan Content ID yaitu merupakan sistem yang dapat mengidentifikasi kesamaan video. Sebaiknya ntuk menangani tindakan unggah ulang video Youtube ke Platform lain seperti Instagram atau Tiktok dibutuhkannya penggunaan Digital Right Management System (DRMs). Video Youtube termasuk kedalam ciptaan yang dilindungi terdapat pada pasal 40 ayat (1) UU Hak Cipta yaitu karya sinematografi, perlindungan hukum secara preventif yaitu dapat dilakukan dengan mendaftarkan hasil karyanya ke Direktorat Jenderal Kekayaan Intelektual dan Perlindungan hukum dengan cara represif yaitu dapat dilakukan alternatif penyelesaian sengketa, arbitrase, atau pengadilan. Ketentuan pidana pelanggaran hak cipta diatur di dalam pasal 112 dan pasal 113 ayat (3) UU Hak Cipta. Kata Kunci : Hak Cipta, Orisinalitas dan Youtube. ABSTRACT This study aims to determine and analyze the originality determination system on the platform Youtube and Legal protection against video creators Youtube for the action of re-uploading without citing the source of the creator. The type of research used in this study is a normative juridical legal research method using a statutory and conceptual approach. The results of this study indicate that in policy settings Youtube the first person to upload a video is considered the creator of the video. so the originality or authenticity of a video is seen from the person who first uploaded the video to Youtube. To handle video actions Youtube re-uploaded by channel Youtube others policy rules Youtube own Copyright Match Tool and Content ID which is a system that can identify video similarities. To handle video re-upload action Youtube to other Platforms such as Instagram or Tiktok needed use Digital Right Management System (DRMs). Video Youtube included in the creation that is protected is contained in article 40 paragraph (1) of the Copyright Law, namely cinematographic works, preventive legal protection, which can be done by registering their works with the Directorate General of Intellectual Property and Legal Protection in a repressive way, namely alternative dispute resolution, arbitration can be carried out , or court. Criminal provisions for copyright infringement are regulated in article 112 and article 113 paragraph (3) of the Copyright Law. Keywords: Copyright, Originality and Youtube.
