Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis akibat hukum terhadap para pihak dengan terjadinya pembatalan sertipikat hak atas tanah pada kasus Putusan Nomor 21/Pdt.G/2012/PTUN.Jbi dan untuk mengetahui dan menganalisis perlindungan hukum terhadap pihak yang tercatat dalam sertipikat hak milik yang dibatalkan oleh hakim pada kasus Putusan Nomor 21/Pdt.G/2012/PTUN.Jbi. Metode penelitian yang digunakan adalah tipe penelitian yuridis empiris. Hasil penelitian menunjukkan bahwa 1) Akibat hukum terhadap para pihak dengan terjadinya pembatalan sertipikat hak atas tanah pada kasus Putusan Nomor 21/Pdt.G/2012/PTUN.Jbi, sebagai berikut digolongkan sebagai perbuatan melawan hukum sehingga tindakan M. Darmawan Yahya dapat dilakukan gugatan secara perdata untuk meminta sejumlah uang ganti rugi, asset pihak M. Darmawan Yahya sebagai pihak yang melakukan penguasaan tanpa hak tersebut bisa dilakukan eksekusi dengan cara membongkar bangunan yang ada di atas tanah tersebut dan SHM atas nama M. Darmawan Yahya seharusnya tidak bisa dijadikan alas hak penguasaan tanah tersebut; 2) Perlindungan hukum terhadap pihak yang tercatat dalam sertipikat hak milik yang dibatalkan oleh hakim pada kasus Putusan Nomor 21/Pdt.G/2012/PTUN.Jbi bahwa pemegang sah hak atas tanah harus diberikan perlindungan baik secara represif yaitu dengan adanya ketentuan pada Peraturan Pemerintah Nomor 18 Tahun 2021 Tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun, dan Pendaftaran Tanah dan secara preventif, yaitu peran hakim dalam menentukan pemegang sah hak atas tanah dengan adanya sertipikat hak milik atas tanah, dan dengan memberikan upaya hukum yang mencakup upaya hukum perlawanan (verzet), banding, dan kasasi. Kata kunci: Pembatalan, Sertipikat Hak Atas Tanah This study aims to determine and analyze the legal consequences for the parties with the cancellation of the certificate of land rights in the case of Decision Number 21/Pdt.G/2012/PTUN.Jbi and to determine and analyze the legal protection of the parties recorded in the certificate of property rights which canceled by the judge in the case of Decision Number 21/Pdt.G/2012/PTUN.Jbi. The research method used is an empirical juridical research type. The results of the study show that 1) The legal consequences for the parties with the cancellation of land rights certificates in the case of Decision Number 21/Pdt.G/2012/PTUN.Jbi, as follows are classified as unlawful acts so that the actions of M. Darmawan Yahya can be sued civilly to ask for a sum of compensation, the assets of M. Darmawan Yahya as the party exercising control without these rights can be executed by dismantling the existing building on the land and SHM in the name of M. Darmawan Yahya should not be used as the basis for rights mastery of the land; 2) Legal protection for parties registered in the property rights certificate which was canceled by the judge in the case of Decision Number 21/Pdt.G/2012/PTUN.Jbi that the legal holders of land rights must be given protection both repressively, namely by the existence of provisions in Government Regulations Number 18 of 2021 concerning Management Rights, Land Rights, Flats Units, and Land Registration and preventively, namely the role of judges in determining the legal holder of land rights by having a certificate of ownership of land, and by providing legal remedies that include legal remedies resistance (verzet), appeal, and cassation.
