Abstract

ABSTRAK Tujuan penelitian adalah 1)Untuk mengetahui dan menganalisis pengaturan hukum perampasan barang milik pihak ketiga terhadap tindak pidana kehutanan berdasarkan Peraturan Perundang-Undangan di Indonesia. 2)Untuk mengetahui dan menganalisis kebijakan hukum pidana yang lahir terhadap upaya menegakan hukum yang seadil adilnya ke depan tentang perampasan aset atas tindak pidana kehutanan. Dengan tujuan tersebut maka masalah yang di bahas adalah: 1. Bagaimana pengaturan hukum perampasan aset terhadap Tindak Pidana Kehutanan berdasarkan Peraturan Perundang-Undangan di Indonesia? 2. Bagaimana kebijakan hukum pidana kedepan tentang perampasan aset atas tindak pidana kehutanan dalam pengembalian kerugian negara? Dengan perumusan masalah tersebut maka metode penelitian yang digunakan adalah penelitian tipe yuridis normatif melalui Pendekatan konseptual (Conseptual Approach), Pendekatan Perundang-Undangan (Statue Approach), Pendekatan Kasus (Cases Approach). Bahan hukum yang dikumpulkan adalah: bahan hukum primer, bahan hukum skunder, bahan hukum tersier. Analisis bahan hukum yang terkumpul dilakukan dengan cara menginterventarisasi mensistematisasi dan menginterpretasikan. hasil penelitian menunjukan bahwa: Dalam peraturan yang mengatur tentang tindak pidana illegal logging tersebut adanya Pasal 16 Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan dan Penjelasannya juga menegaskan perampasan dimaksudkan agar pemilik jasa angkut ikut bertanggung jawab atas keabsahan hasil hutan. Putusan perkara perlawanan pihak ketiga (derden verzet) terhadap putusan perkara pidana hanya bersifat memperbaiki status barang bukti yang menjadi objek putusan pidana, khususnya mengenai hal-hal yang merugikan pihak ketiga. Kata Kunci: Tindak Pidana, Illegal Logging, dan Perlindungan Hukum. ABSTRACT The research objectives are 1) to find out and analyze the legal arrangements for confiscation of third party property against forestry crimes based on Indonesian laws and regulations. 2) To find out and analyze criminal law policies that are born towards efforts to uphold the law as fairly as possible in the future regarding asset confiscation for forestry crimes. With this aim, the issues discussed are: 1. How is the legal regulation of asset confiscation against forestry crimes based on laws and regulations in Indonesia? 2. What is the future criminal law policy regarding asset confiscation for forestry crimes in recovering state losses? With the formulation of the problem, the research method used is normative juridical type research through a conceptual approach (Conceptual Approach), Statute Approach, Case Approach. The legal materials collected are: primary legal materials, secondary legal materials, tertiary legal materials. Analysis of the collected legal materials is carried out by way of systematizing and interpreting inventory. The results of the research show that: In the regulations governing the criminal act of illegal logging there is Article 16 of Law Number 18 of 2013 concerning the Prevention and Eradication of Forest Destruction and its Explanation which also emphasizes that expropriation is intended so that the owner of the transport service is also responsible for the legitimacy of forest products. Decisions in cases against third parties (derden verzet) against decisions in criminal cases are only to improve the status of evidence that is the object of criminal decisions, especially regarding matters that are detrimental to third parties.
