Abstract

ABSTRAK Penelitian ini bertujuan 1)Untuk mengetahui dan menganalisis pengaturan pertanggungjawaban pidana terhadap pelaku kekerasan seksual terhadap penyandang disabilitas intelektual; 2)Untuk mengetahui dan menganalisis perspektif hukum pidana Indonesia kedepannya kejahatan pelaku kekerasan seksual terhadap penyandang disabilitas intelektual menjadi pemberatan pidana. Metode penelitian yaitu metode hukum normatif dengan pendekatan; perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil penelitian menunjukkan bahwa 1)Pertanggungjawaban pidana pelaku kekerasan seksual terhadap penyandang disbilitas intelektual, sanksi terhadap pelaku tindak pidana terdapat dalam hukum positif di Indonesia. Pada Putusan Pengadilan yang penulis teliti sanksi bagi pelaku kejahatan perkosaan terhadap seorang disabilitas lebih merunjuk pada Pasal 285 dan 286 KUHP dimana seorang disabilitas termasuk kedalam unsur tidak berdaya pada Pasal 286 KUHP yang di mana seorang disabilitas tidak berdaya melawan atau menyelamatkan dirinya karena faktor kekurangan yang mereka miliki; 2)Perspektif hukum pidana Indonesia kedepannya kepada pelaku kejahatan seksual terhadap penyandang disabilitas diberlakukan pidana tambahan berupa penambahan sanksi pidana 1/3. Dari hasil penelitian dapat direkomendasikan bahwa perlu adanya penambahan norma baru dalam Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas berkaitan dengan sanksi pidana bagi pelaku kejahatan kekerasan seksual terhadap penyandang disabilitas dengan tujuan meningkatkan efek jera terhadap para pelaku kejahatan seksual tersebut. Kata kunci : Pertanggungjawaban Pidana, Kekerasan Seksual, dan Disabilitas Intelektual ABSTRACT This study aims 1) to identify and analyze criminal liability arrangements for perpetrators of sexual violence against persons with intellectual disabilities; 2) to find out and analyze the perspective of Indonesian criminal law in the future, crimes of perpetrators of sexual violence against persons with intellectual disabilities will become criminal sanctions. The research method is the normative legal method with an approach; legislation, conceptual approach and case approach. The results of the study show that 1) criminal responsibility for perpectrators of sexual violence against persons with intellectual disabilities, sanctions for perpetrators of criminal acts are contained in positive law in Indonesia. In the Court Decision, the author examined the sanctions for the perpetrators of rape crimes against a disability, referring more to Articles 285 and 286 of the Criminal Code where a person with a disability is included in the element of helplessness in Article 286 of the Criminal Code, where a person with a disability is powerless to fight or save himself because of the deficiencies they have. ; 2) from the perspective of Indonesian criminal law in the future, perpetrators of sexual crimes against persons with disabilities will be subject to additional punishment in the form of additional criminal sanctions 1/3. From the research results it can be recommended that there is a need to add new norms to Law Number 8 of 2016 concerning Persons with Disabilities relating to criminal sanctions for perpetrators of crimes of sexual violence against persons with disabilities with the aim of increasing a deterrent effect on perpetrators of these sexual crimes.
