Abstract

Tujuan dari penelitian ini adalah untuk mengetahui pelaksanaan perjanjian pinjam meminjam antara anggota dengan Koperasi Melin Sari di Kota Jambi, serta kendala dalam pelaksanaan perjanjian pinjam meminjam antara anggota dengan Koperasi Melin Sari di Kota Jambi. Jenis penelitian adalah yuridis empiris. Hasil penelitian menunjukkan bahwa pelaksanaan hak dan kewajiban para pihak dalam perjanjian pinjam meminjam antara anggota dengan Koperasi Melin Sari di Kota Jambi belum terlaksana dengan baik, terutama kewajiban anggota koperasi untuk membayar pinjaman sesuai waktu yang ditentukan, pelaksanaan hak koperasi untuk membatalkan perjanjian apabila anggota telat membayar berkali-kali, serta kewajiban koperasi terhadap peminjam/penanggungjawab yang meninggal dunia, sehingga asas pacta sunt servanda dalam perjanjian pinjam meminjam antara Koperasi Melin Sari dengan anggota belum terpenuhi, karena ada beberapa hak dan kewajiban yang telah tercantum dalam surat perjanjian tidak terlaksana.. Kendala yang sering dihadapi dalam pelaksanaan perjanjian pinjam meminjang antara anggota dengan Koperasi Melin Sari di Kota Jambi adalah permasalahan wanprestasi, sehingga perjanjian mengenai prosedur pembayaran pimjaman tidak dapat berjalan sebagaimana mestinya. The purpose of this research is to find out the implementation of the loan agreement between members and the Melin Sari Cooperative in Jambi City, as well as the constraints in implementing the loan agreement between members and the Melin Sari Cooperative in Jambi City. This type of research is empirical juridical. The results of the study show that the implementation of the rights and obligations of the parties in the lending and borrowing agreement between members and the Melin Sari Cooperative in Jambi City has not been carried out properly, especially the obligations of cooperative members to pay loans according to the specified time, the implementation of cooperative rights to cancel the agreement if members are late paying many times, as well as the cooperative's obligations to the borrower/responsible person who died, so that the principle of pacta sunt servanda in the loan agreement between the Melin Sari Cooperative and members has not been fulfilled, because there are several rights and obligations that have been stated in the agreement letter which are not implemented.. Constraints which is often encountered in the implementation of loan agreements between members and the Melin Sari Cooperative in Jambi City is the problem of default, so that agreements regarding loan payment procedures cannot work as they should.
