Abstract

Skripsi ini bertujuan untuk mengetahui dan menganalisis pertimbangan hakim dalam pembagian warisan untuk janda menurut hukum waris islam serta untuk mengetahui kendala yang dihadapi dalam pembagian warisan menurut hukum waris Islam dan untuk mengetahui dan menganalisis upaya yang dilakukan janda dalam menuntut hak warisan menurut hukum waris Islam. Permasalahan penelitian 1) Bagaimana pertimbangan hakim dalam pembagian warisan untuk janda menurut hukum waris Islam. 2) Kendala yang dihadapi dalam pembagian warisan menurut hukum waris Islam dan upaya yang dilakukan janda dalam menuntut hak warisan menurut hukum waris Islam. Skripsi ini menggunakan Metode penelitian yuridis empiris. Hasil penelitian ini menunjukkan pertimbangan hakim di putusan nomor 76/Pdt.G/2018/Pa.Sgt, bahwa penggugat (Janda) tersebut tidak mendapatkan hak dari harta peninggalan suaminya karena gugatan penggugat cacat formil, maka dalam putusan tersebut juga penggugat (Janda) harus membayar semua biaya perkara gugatan di Pengadilan Agama Sengeti. Kendala yang dihadapi hakim dalam pembagian warisan menurut hukum Islam, bahwa kedudukan tersebut harus disiapkan oleh hakim untuk dapat menuntaskan kasus seberat apap tanpa adanya persepsi ataupun kendala. Upaya yang dapat dilakukan oleh janda sebagaimana dijelaskan dalam Kompilasi Hukum Islam Pasal 180 bahwa janda mendapat seperempat bila pewaris tidk meninggalkan anak, dan bila pewaris meninggalkan anak, maka janda mendapat seperdelpan bagian. Kata kunci: Pembagian Warisan, Janda, Hukum Waris Islam This thesis aims to know and analyze the consideration of judges in the distribution of inheritance for widows according to Islamic inheritance law and to know the obstacles faced in the distribution of inheritance according to Islamic inheritance law and to know and analyze the efforts made by widows in demanding inheritance rights according to Islamic inheritance law. Research problem 1) How is the consideration of judges in the distribution of inheritance for widows according to Islamic inheritance law. 2) Obstacles faced in the distribution of inheritance according to Islamic inheritance law and efforts made by widows in demanding inheritance rights according to Islamic inheritance law. This thesis uses empirical juridical research method. The results of this study indicate the judge's consideration in decision number 76/Pdt.G/2018/Pa.Sgt, that the plaintiff (Widow) did not get the right from her husband's inheritance because the plaintiff's lawsuit was formally defective, so in the decision the plaintiff (Widow) must pay all the costs of the lawsuit at the Sengeti Religious Court. The obstacles faced by judges in the distribution of inheritance according to Islamic law, that this position must be prepared by judges to be able to resolve cases as heavy as anything without any perception or obstacles. Efforts that can be made by widows as explained in the Compilation of Islamic Law Article 180 that widows get a quarter if the testator does not leave children, and if the testator leaves children, then the widow gets a half share.
