Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui dan menganalisis bentuk perlindungan hukum terhadap konsumen akibat pernyataan pailit perusahaan perumahan real estate. dan untuk mengetahui bentuk penyelesaian sengketa antara konsumen dengan perusahaan perumahan real estate yang dinyatakan pailit. Penelitian ini menggunakan metode yuridis normatif, yaitu penelitian yang dilakukan dengan cara menganalisis, mempelajari, dan menafsirkan aturan-aturan hukum yang berlaku. Hasil dari penelitian ini yaitu perlindungan hukum terhadap konsumen yang pengembangnya dinyatakan pailit masih lemah. Karena konsumen pemegang PPJB akan diposisikan sebagai kreditor konkuren dan mendapat ganti kerugian paling akhir. Dalam Undang-Undang kepailitan belum tegas mengatur hak-hak konsumen saat perusahaan perumahan real estate dinyatakan pailit. Sehingga banyak perusahaan perumahan yang beritikad tidak baik. Bentuk penyelesaian sengketa yang dapat dilakukan yaitu konsumen mengajukan tagihan utang kepada kurator dengan jangka waktu yang telah ditetapkan oleh Hakim Pengawas. Kata Kunci: Perlindungan Hukum, Kepailitan, Perusahaan Perumahan. ABSTRACT The purpose of this study was to identify and analyze the form of legal protection for consumers due to bankruptcy declarations by real estate housing companies. and to find out the form of dispute resolution between consumers and housing real estate companies that have been declared bankrupt. This research uses a normative juridical method, namely research conducted by analyzing, studying, and interpreting the applicable legal rules. The results of this research are that legal protection for consumers whose developers are declared bankrupt is still weak. Because consumers holding PPJB will be positioned as concurrent creditors and will receive the final compensation for losses. The bankruptcy law does not clearly regulate consumer rights when a housing real estate company is declared bankrupt. So many housing companies have bad intentions. The form of dispute resolution that can be done is that the consumer submits a debt claim to the curator with a period of time determined by the Supervisory Judge.
