Abstract
Penelitian ini dilatar belakangi adanya Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 11 Tahun 2019 tentang Perubahan kedua atas Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 25 tahun 2018 tentang Pengusahaan Pertambangan dan Mineral Batubara memutuskan untuk memberhentikan kegiatan ekspor bijih nikel mulai dari tanggal 1 Januari 2020. Peraturan ini dianggap melanggar prinsip restriksi kuantitatif dalam pasal XI General Agreement on Tariffs and Trade dan dituntut oleh Uni Eropa kepada Dispute Settlement Body World Trade Organization.Penelitian ini dilakukan dengan tujuan untuk dapat mengetahui bagaimana kekuatan mengikat putusan World Trade Organization dalam menyelesaikan Sengketa dagang internasional dan implementasiya. Adapun Metode yang digunakan dalam penelitian ini menggunakan metode pendekatan yuridis normatif. Hasil penelitian ini melnulnjulkkan bahwa kelbijakan larangan elkspor bijih nikell Indonelsia dianggap mellanggar atulran pelrdagangan belbas yang diatulr olelh WTO. Ulni Elropa selbagai pihak yang melnggulgat dinyatakan selbagai pihak yang melnang dalam selngkel ta ini.Indonelsia haruls melmatulhi kelpultulsan telrselbult dan melnghelntikan kelbijakan larangan elkspor bijih nikell yang dianggap mellanggar pelratulran WTO dalam penyelesaian sengketa dagang internasional bagi negara yang bersengketa. Implementasi hasil putusan yang dapat dilakukan oleh negara Indonesia ialah melmatulhi hasil pultulsan kelmuldian melngambil langkah-langkah ulntulk melnghapuls larangan elkspor bijih nikell dan mellakulkan pelrulbahan pada ulndangulndang dan pelratulran yang ada. This research is motivated by the Minister of Energy and Mineral Resources Regulation Number 11 of 2019 concerning the second amendment to the Minister of Energy and Mineral Resources Regulation Number 25 of 2018 concerning Coal Mining and Mineral Exploitation, which decided to stop nickel ore export activities starting from January 1, 2020 This regulation is considered to violate the principle of quantitative restrictions in article XI of the General Agreement on Tariffs and Trade and is demanded by the European Union against the Dispute Settlement Body of the World Trade Organization. and its implementation. The method used in this study uses a normative juridical approach. The results of this study show that Indonesia's nickel ore export ban policy is considered to have violated the free trade rules set by the WTO. Ulni Elropa, as the party that succumbed, was declared as the party that won in this dispute. Indonesia must accept the decision of the latter and stop the policy of prohibiting the export of nickel ore which is considered to have violated WTO regulations in settling international trade disputes for the disputing countries. The implementation of the results of the decision that can be carried out by the Indonesian state is to comply with the results of the decision and then take steps to remove the ban on the export of nickel ore and make changes to existing laws and regulations.
