Abstract

Tujuan dari penelitian ini adalah: Untuk mengetahui dan menganalisis Hakim dalam menerapkan pemidanaan terhadap perkara tindak Pemalsuan Gelar Akademik dalam kasus 265/Pid.sus/2022/PN.Jmb & nomor 100/Pid.sus/2020/PN.Gpr dan hal-hal yang memberatkan dan meringankan menurut Hakim dalam memutus perkara tindak Pemalsuan Gelar Akademik dalam kasus 265/Pid.sus/2022/PN.Jmb & nomor 100/Pid.sus/2020/PN.Gpr. Tipe penelitian ini adalah yuridis normatif dengan menggunakan pendekatan Undang- Undang (statute approach), pendekatan kasus (case approach), pendekatan historis (historical approach), pendekatan perbandingan (comparative approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa: 1) Bagaimanakah dasar pertimbangan majelis hakim dalam menerapkan pidana terhadap perkara tindak pidana pemalsuan identitas menggunakan gelar akademik dalam Pasal 93 Jo Pasal 28 Ayat (7) Undang-Undang Nomor 12 Tahun 2012 Tentang Pendidikan Tinggi (Analisis Putusan Nomor 265/Pid.sus/2022/PN.Jmb & Nomor 100/Pid.Sus/2020/PN.Gpr) dan Apa saja kah hal-hal yang memberatkan dan meringankan hakim dalam mempertimbangkan dan memutus perkara tindak pidana pemalsuan identitas menggunakan gelar akademik dalam Pasal 93 Jo Pasal 28 Ayat (7) Undang-Undang Nomor 12 Tahun 2012 Tentang Pendidikan Tinggi (Analisis Putusan Nomor 265/Pid.sus/2022/PN.Jmb & Nomor 100/Pid.Sus/2020/PN.Gpr). Kata Kunci: Gelar Akademik, Pemidanaan, Pemalsuan. The purpose of this study is: To find out and analyze Judges in applying punishment to cases of forgery of Academic Degrees in case 265/Pid.sus/2022/PN.Jmb & number 100/Pid.sus/2020/PN.Gpr and matters aggravating and mitigating according to the Judge in deciding the case of forgery of Academic Degrees in case 265/Pid.sus/2022/PN.Jmb & number 100/Pid.sus/2020/PN.Gpr. This type of research is normative juridical using a statute approach, case approach, historical approach, comparative approach, and conceptual approach. The results of the study show that: 1) What is the basis for the consideration of the panel of judges in applying the penalty to the crime of identity fraud using an academic degree in Article 93 Jo Article 28 Paragraph (7) of Law Number 12 of 2012 Concerning Higher Education (Decision Analysis Number 265/ Pid.sus/2022/PN.Jmb & Number 100/Pid.Sus/2020/PN.Gpr) and What are the aggravating and mitigating factors for judges in considering and deciding on cases of the crime of falsifying identity using academic degrees in Article 93 Jo Article 28 Paragraph (7) Law Number 12 of 2012 Concerning Higher Education (Decision Analysis Number 265/Pid.sus/2022/PN.Jmb & Number 100/Pid.Sus/2020/PN.Gpr).
