Abstract

ABSTRAK Tujuan dari penelitian ini adalah 1). Untuk mengetahui dan menganalisis bagaimana prosedur pelaksanaan pemilihan Rio di Dusun Simpang Babeko pada tahun 2022, dan 2). Untuk mengetahui dan menganalisis apakah pemilihan Rio Dusun Simpang Bebeko tahun 2022 sudah sesuai dengan Peraturan Daerah Kabupaten Bungo Nomor 12 Tahun 2018. Metode penelitian yang digunakan adalah yuridis empiris dengan mendeskripsikan permasalahan-permasalahan yang terjadi sesuai dengan fakta yang ditemukan dari hasil penelitian yang telah dilakukan. Hasil penelitian ini menunjukkan bahwa dalam pelaksanaan pemilihan Rio Dusun Simpang Babeko terdapat pelanggaran hukum yang melanggar beberapa ketentuan dalam Peraturan Daerah Kabupaten Bungo Nomor 12 Tahun 2018 Tentang Pemilihan, Pengangkatan dan Pemberhentian Rio. Adapun pelanggaran-pelanggarannya antara lain tidak terpenuhinya struktur kepanitiaan pemilihan Rio, praktik Money Politic, keterlibatan Anggota Badan Permusyawaratan Dusun, masalah Daftar Pemilih Tetap (DPT), dan keterpihakan Ketua Panitia pemilihan terhadap salah satu calon Rio. Selain itu berdasarkan hasil penelitian dapat disimpulkan bahwa pemilihan Rio Dusun Simpang Babeko merupakan pemilihan yang cacat secara hukum karena terdapat beberapa pelanggaran-pelanggaran hukum yang membuat pemilihan tersebut tidak sesuai dengan peraturan perundang-undangan yang berlaku khususnya Peraturan Daerah Kabupaten Bungo Nomor 12 Tahun 2018 Tentang Pemilihan, Pengangkatan dan Pemberhentian Rio. To find out and analyze how the procedures for carrying out the Rio election in Simpang Babeko Hamlet in 2022, and 2). To find out and analyze whether the election for Rio Dusun Simpang Bebeko in 2022 is in accordance with Regional Regulation Bungo Regency Number 12 of 2018. The research method used is empirical juridical by describing the problems that occur in accordance with the facts found from the results of research that has been done. The results of this study indicate that during the implementation of the Rio election in Simpang Babeko Hamlet there were legal violations that violated several provisions in the Bungo Regency Regional Regulation Number 12 of 2018 Concerning Rio's Election, Appointment and Dismissal. The violations included the non-fulfillment of the structure of the Rio election committee, the practice of money politics, the involvement of Hamlet Consultative Council members, the issue of the Fixed Voter List (DPT), and the election committee chairman's partiality towards one of Rio's candidates. In addition, based on the results of the study, it can be concluded that the election for Rio Dusun Simpang Babeko was an election that was legally flawed because there were several legal violations that made the election not in accordance with the applicable laws and regulations, especially Regional Regulation Bungo Regency Number 12 of 2018 Concerning Elections , Appointment and Dismissal of Rio.
