Abstract

ABSTRACT This study is entitle an analysis of the implementation of regional regulation Number 3 of 2012on mining business permits in Pasaman, Dua Koto sub-district Cubadak Simpang Tonang. The formulation of the problem poset is: How is the goverments policy to ward mining business parmits against regional regulations number 3 of 2012 in Pasaman, Dua Koto sub-district, Cubadak Simpang Tonang?How is the implementation of regional mining business permits in Pasaman, Dua Koto, Cubadak, Simpang Tonang district? The type of research used is descriptive qualitative with data collected through interviews from related agencies, observation and documentation while the analysis was done descriptively. The findings show that there hasben a violation of article 115 paragraph (1) which reads that anyone without an IUP shall be punished according to the provisions of law Number 4 of 2009 concerning mineral an coal mining. As referred to in article 158 imprisonment for a maximum of 10 (ten) year and a maximu fine of Rp.10.000.000.000.00 (ten billion rupiah). Good mining in the Dua Koto sub-district has caused negative impacts on the community, both environmental damage an conflict between the local community and the company. As for the efforts made by the provincial government of west sumatera as the policy maker is to increase the guldance and supervision of illegal mining and the imposition of sanction for companies that do not apply mining principles Keywords: Implementation, Mining License
