Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui 1). bagaimana pelaksanaan mediasi dalam penanganan sengketa pertanahan di Kantor Badan Pertanahan Nasional Kabupaten Merangin dan 2). Apa yang menjadi hambatan Kantor Badan Pertanahan Nasional Kabupaten Merangin dalam menjalankan mediasi. Metode penelitian yang digunakan dalam penelitian ini adalah menggunakan tipe penelitian yang bersifat yuridis empiris. Penelitian hukum empiris bertujuan untuk mengetahui sejauh mana berkerjanya hukum di dalam masyarakat. Hasil penelitiannya, yakni 1). Pelaksanaan mediasi di kantor Badan Pertanahan Nasional Merangin mengalami banyak kegagalan. Hal tersebut diketahui dari data yang didapat pada tahun 2019-2022 terdapat 5 sengketa pertanahan, dan keseluruhannya tidak dapat diselesaikan secara mediasi. 2). Terdapat 2 hambatan yang dihadapi dalam menyelesaikan sengketa melalui mediasi di BPN Merangin. Pertama, secara internal Masih kurangnya sumber daya manusia yang terdapat di kantor pertanahan kabupaten merangin, khususnya di sub seksi Sengketa, Konflik dan Perkara Pertanahan yang bertugas untuk menyelesaikan kasus pertanahan yang ada pada kantor pertanahan kabupaten merangin. Kedua, secara eksternal Terdapat pihak yang tidak beritikad baik untuk penyelesaian sengketa dan rendahnya partisipasi para pihak, Tidak lengkapnya data pendukung dari para pihak. Serta tidak bersedianya salah satu pihak untuk dilaksanakan kegiatan penelitian fisik dalam proses persiapan pelaksanaan mediasi. Kurangnya sumber daya manusia yang tersedia di kantor badan pertanahan nasional kabupaten merangin, terutama di sub seksi sengketa, konflik, dalam perkara pertanahan. Dengan adanya keterbatasan sumber daya manusia, kantor tersebut mungkin kesulitan dalam menangani banyak kasus sengketa pertanahan yang ada. Kata Kunci : Sengketa Tanah, Mediasi, Badan Pertanahan Nasional. ABSTRACT This research aims to find out 1). how is the implementation of mediation in handling land disputes at the Office of the National Land Agency of Merangin Regency and 2). What are the obstacles to the Merangin District National Land Agency Office in carrying out mediation. The research method used in this study is to use a type of research that is empirical juridical. Empirical legal research aims to determine the extent to which law works in society. The results of the research are 1). Mediation at the Merangin National Land Agency office experienced many failures. It is known from the data obtained that in 2019-2022 there were 5 land disputes, and all of them could not be resolved through mediation. 2). There are 2 obstacles faced in resolving disputes through mediation at BPN Merangin. First, internally there is still a lack of human resources in the Merangin district land office, especially in the sub-section of Disputes, Conflicts and Land Cases which is tasked with resolving land cases in the Merangin district land office. Second, externally there are parties who do not have good faith in resolving disputes and the participation of the parties is low. Supporting data from the parties is incomplete. As well as the unwillingness of one of the parties to carry out physical research activities in the process of preparing for the implementation of mediation. The lack of human resources available at the district office of the national land agency is merangin, especially in the sub-section of disputes, conflicts, in land matters. With limited human resources, the office may find it difficult to handle the many cases of land disputes that exist. Keywords : Land Disputes, Mediation, National Land Agency.
