Abstract

Tindakan diskriminasi rasial di india telah menjadi isu yang kontroversial dalam beberapa tahun terakhir. perselisihan antara muslim dan hindu di india telah terjadi berabad abad, tetapi kontroversial baru-baru ini muncul karena tindakan pemerintah india yang dituduh diskriminatif terhadap minoritas muslim di negara tersebut. Hal ini diperdebatkan dalam konvensi internasional tentang penghapusan segala bentuk diskriminasi rasial (ICERD) tahun 1965, yang bertujuan untuk menghapuskan segala bentuk diskriminasi rasial. ICERD menetapkan bahwa diskriminasi rasial termasuk pengasingan ,diskriminasi dalam pendidikan dan pekerjaan, sertapenghindaran akses ke tempat-tempat umum dan layanan public. Beberapa tindakan yang diambil oleh pemerintahan indiatelah dianggap sebagai tindakan diskriminatif terhadap muslim, termasuk undang-undang kewarganegaraan yang kontroversial dan larangan daging sapi di beberapa negara bagian. Hal ini dianggap sebagai bentuk diskriminasi rasial dan agama yang melanggar prinsip-prinsip ICERD. Meskipin india menandatangani ICERD, negara tersebut belum meratifikasi konvensi tersebut, oleh karena itu, india tidak secara resmi terikat pada prinsip-prinsip yang terkandung dalam konvensi tersebut. Namun, sebagai anggota PBB, india diharapkan untuk mematuhi prinsip-prinsip yang terkandung dalam konvensi tersebut. Dalam hal ini, tindakan diskriminasi rasial terhadap muslim di india harus dilihat sebagai suatu pelanggaran terhadap hak asasi manusia dan prinsip-prinsip kesetaraan yang dijamin oleh konvensi internasional. Negara-negara lain dan komunitas internasional harus mengambil tindakan untuk memastikan bahwa india mematuhi prinsip-prinsip ICERD dan melindungi hak-hak minoritas muslim di negara tersebut. Kata Kunci: Diskriminasi rasial, ICERD tahun 1965, muslim di india. Acts of racial discrimination in India have become a controversial issue in recent years. Disputes between Muslims and Hindus in India have been going on for centuries, but controversy recently emerged due to the actions of the Indian government which were accused of being discriminatory against the Muslim minority in the country. This was debated in the 1965 international convention on the elimination of all forms of racial discrimination (ICERD), which aims to eliminate all forms of racial discrimination. ICERD stipulates that racial discrimination includes exclusion, discrimination in education and employment, and avoidance of access to public places and public services. Several actions taken by the Indian government have been deemed discriminatory against Muslims, including controversial citizenship laws and beef bans in several states. This is considered a form of racial and religious discrimination that violates the ICERD principles. Although India is a signatory to ICERD, it has not ratified the convention, therefore, India is not officially bound by the principles contained in the convention. However, as a member of the United Nations, India is expected to comply with the principles contained in the convention. In this case, acts of racial discrimination against Muslims in India must be seen as a violation of human rights and the principles of equality guaranteed by international conventions. Other countries and the international community must take action to ensure that India adheres to the ICERD principles and protects the rights of the Muslim minority in the country.
