Abstract

Masyarakat Kecamatan Koto Baru beranggapan bahwa menggadaikan tanah sawah gilir ganti di perbolehkan sebab niatnya ialah membantu sanak saudara, tetangga, ataupun orang yang membutuhkan bantuan. Dalam pelaksanaan gadai tanah sawah di Kecamatan Koto Baru gadai yang terjadi dibuat berdsarkan kesepakatan antara pihak penggadai dan pemegang gadai perjanjian di buatsecara tertulis di atas surat pegang gadai. Dalam permasalahan skripsi ini adalah: a) Bagaimana pelaksanaan gadai tanah sawah secara gilir ganti menurut Hukum Adat dan faktor penyebab terjadinya gadai tanah sawah di Kecamatan Koto Baru Kota Sungai Penuh. b) Bagaimana upaya dan cara penyelesaian Gadai Tanah Sawah di Kecamatan Koto Baru. Penelitian ini bertujuan untuk mengetahui dan menganalisis pelaksanaan gadai tanah sawah yang menggunakan tanah sawah gilir ganti menurut Hukum Adat, untuk mengetahui yang menjadi faktor penyebab terjadinya gadai tanah sawah di Kecamatan Koto Baru Kota Sungai Penuh dan Bagaimana upaya dan cara penyelesaian gadai tanah sawah yang terjadi di Kecamatan Koto Baru Kota Sungai Penuh. Metode Penelitian yang digunakan adalah yuridis empiris yaitu bertujuan untuk mengamati fakta-fakta hukum yang berlaku di tengah masyarakat sebagai budaya hidup masyarakat, pendekatan penelitian yang dilakukan penulis ialah pendekatan kualitatif yang artianya penelitian ini dilaksanakan dengan tujuan memahami fenomena tentang apa yang dialami subjek penelitian. Hasil penelitian menunjukan 3 (tiga) responden yang melakukan gadai tanah sawah tidak sesuai dengan kesepakatan yang telah di buat. Seharusnya permasalahan diselesaikan menurut ketentuan Hukum Adat di Kecamatan Koto Baru, agar dapat diselesaikan oleh teganai secara musyawarah . karena masyarakat seringkali melakukan gadai tanah sawah tidak sesuai perjanjian yang telah disepakati.People at Koto Baru Subdistrict Sungai Penuh City assume that mortgaging rice fields in turn is permissible because the intention is to help relatives, neighbors, or people who need help In the implementation of pawning rice fields at Koto Baru Subdistrict the pledge that occurs is made based on an agreement between the pawnbroker and the pledgee. The agreement is made in writing on the letter of holding the pledge. In this thesis the problem is: a) How is the implementation of pawning of rice fields in turn according to Customary Law and the factors that cause pawning of rice fields at Koto Baru Subdisrict Sungai Penuh City. b) What are the efforts and methods for resolving a rice field Land Pawn at Koto Baru Subdisrict Sungai Penuh City. This research aims to find out and analyze the implementation of paddy land pawning using paddy land in rotation according to Customary Law, to find out the factors that cause paddy land pawning to occur at Koto Baru Subdisrict Sungai Penuh City and What are the efforts and methods for resolving paddy land pawnings that occur at Koto Baru Subdisrict Sungai Penuh City. The research method used is empirical juridical, which aims to observe the legal facts that apply in society as a culture of community life. The research approach used by the author is a qualitative approach, which means this research was carried out with the aim of understanding the phenomenon of what the research subjects experienced. The research results showed that 3 (three) respondents who pawned rice fields did not comply with the agreement that had been made. The problem should be resolved according to the provisions of Customary Law at Koto Baru Subdisrict Sungai Penuh City. so that it can be resolved by the team through deliberation. because people often pawn rice fields not in accordance with the agreed agreements.
