Abstract

Pelayanan publik merupakan suatu tanggung jawab pemerintah beserta aparaturnya kepada masyarakat dalam rangka menciptakan dan mewujudkan kondisi masyarakat yang adil, makmur dan sejahtera. Dalam pelaksanaannya, penyelenggara pelayanan publik dapat menimbulkan kerugian bagi warga masyarakat karena tindakan maladministrasi yang dilakukan penyelenggara pelayanan termasuk salah satunya pelayanan publik di bidang pendidikan khususnya di lingkungan sekolah negeri yang kerap kali menjadi perbincangan terkait pungutan liar yang ada di sekolah tersebut, terbukti berdasarkan data yang di peroleh dari laporan tahunan Ombudsman triwulan l dan ll tahun 2022-2023 sektor pendidikan merupakan salah satu dari 4 (empat) substansi laporan maladministrasi yang cukup sering dilaporkan dari masyarakat kepada Ombudsman yaitu sebanyak 228 laporan. Penelitian ini ditujukan untuk mengetahui fungsi Ombudsman perwakilan Provinsi Jambi dalam menyelesaikan laporan kasus pungutan liar dilingkungan pendidikan khususnya di lingkungan sekolah negeri di Provinsi Jambi dan apa yang menjadi faktor penting dalam pencegahan, pengurangan, serta penyelesaian praktek pungutan liar yang terjadi tersebut dengan mempertimbangkan pungutan liar menjadi permasalahan yang krusial pada sektor pendidikan. Metode penelitian yang digunakan adalah penelitian hukum empiris yang menggunakan data primer sebagai sumber utama, lokasi penelitian berada di Kantor Ombudsman perwakilan Provinsi Jambi, spesifikasi penelitian yang penulis gunakan adalah metode yang bersifat deskriptif analisis. Hasil penelitian menunjukkan bahwa Ombudsman perwakilan Provinsi Jambi dalam menyelesaikan laporan pungutan liar yang terjadi di lingkungan sekolah negeri sudah memenuhi sebagaimana penyelesaian laporan yang sesuai dengan aturan yang berlaku, namum tentunya tetap penting untuk meningkatkan serta memaksimalkan fungsinya sebagai lembaga pengawas pelayanan publik. Kemudian upaya untuk mengatasi hambatan eksternal dalam mengatasi permasalah pungutan liar di bidang pendidikan peranan Pemerintah Daerah dan juga pengambil kebijakan (political will) sangat penting dalam membuat kebijakan hukum daerah dalam hal pengelolaan dana pendidikan yang mencakup aspek keterlibatan masyarakat di wilayahnya. Kata Kunci: Pelayanan Publik, Pendanaan Pendidikan, Pungutan Liar. Public service is a responsibility of the government and its apparatus to the community in order to create and realize conditions for a just, prosperous and prosperous society prosperous. In its implementation, public service providers can cause losses to citizens due to maladministrative actions carried out by service providers, including public services in the education sector, especially in state schools, which often become a topic of discussion regarding illegal levies in these schools, as proven by data provided. Obtained from the Ombudsman's annual report for the first and second quarters of 2022-2023, the education sector is one of the 4 (four) substances of maladministration reports which are quite frequently reported by the public to the Ombudsman, namely 228 reports. This research is aimed at finding out the function of the Ombudsman representing Jambi Province in resolving reports of cases of illegal levies in educational environments, especially in public school environments in Jambi Province and what are the important factors in preventing, reducing and resolving the practice of illegal levies that occur by considering illegal levies is a crucial problem in the education sector. The research method used is empirical legal research which uses primary data as the main source, the research location is at the Ombudsman Office representing Jambi Province, the research specifications that the author uses are descriptive analytical methods. The results of the research show that the Ombudsman representing Jambi Province in completing reports of illegal levies that occur in public schools has complied with completing reports in accordance with applicable regulations, but of course it is still important to improve and maximize its function as a public service supervisory institution. Then efforts to overcome external obstacles in overcoming the problem of illegal levies in the education sector, the role of Regional Government and also policy makers (political will) is very important in making regional legal policies in terms of managing education funds which includes aspects of community involvement in the region.
