Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui dan menganalisis perbandingan fungsi pengawasan antara Panwaslu Tahun 2004 dengan Bawaslu Tahun 2019 serta mengetahui dan menganalisis bagaimana fungsi pengawasan untuk pemilu di tahun 2024 mendatang. Permasalahan dari penelitian ini adalah bagaimana perbandingan fungsi pengawasan oleh Panwaslu pada Pemilu Tahun 2004 dan Bawaslu pada Pemilu Tahun 2019 serta bagaimana fungsi pengawasan pemilihan umum yang demokratis untuk pemilu di tahun 2024 mendatang. Adapun metode penelitian yang digunakan adalah metode yuridis normatif. Hasil penelitian menunjukkan bahwa fungsi pengawasan oleh Panwaslu pada Pemilu Tahun 2004 yang mengacu pada Undang-Undang Nomor 12 Tahun 2003 hanya untuk memastikan pemilu berjalan sesuai dengan ketentuan dan mencegah terjadinya pelanggaran pemilu sedangkan fungsi pengawasan yang dilakukan oleh Bawaslu pada Pemilu Tahun 2019 semakin bertambah banyak yang mengacu pada Undang-Undang Nomor 7 Tahun 2017. Dalam Pemilu Tahun 2019 Bawaslu tidak hanya sekedar mengawasi namun bisa langsung melakukan penindakan terhadap pelanggaran pemilu, bahkan Bawaslu dapat mencegah terjadinya politik uang. Dalam upaya mewujudkan Pemilu demokratis Tahun 2024, fungsi pengawasan yang melibatkan elemen masyarakat adalah sebuah prasyarat utama, tanpa dukungan keterlibatan seluruh masyarakat maka pengawasan akan sulit diwujudkan yang akan mempengaruhi terwujudnya Pemilu demokratis tahun 2024 nanti. Kata Kunci: Bawaslu; Fungsi Pengawasan; Pemilu ABSTRACK The purpose of this study is to find out and analyze the comparison of the oversight function between the 2004 Panwaslu and the 2019 Bawaslu and to know and analyze how the oversight function is for the 2024 elections. The problem of this research is how to compare the oversight function of Panwaslu in the 2004 Election and Bawaslu in the 2019 Election and what is the function of supervising democratic general elections for the upcoming 2024 elections. The research method used is normative juridical method. The results of the study show that the supervisory function of the Panwaslu in the 2004 election which refers to Law Number 12 of 2003 is only to ensure that the election goes according to the provisions and prevent election violations from occurring, while the supervisory function carried out by Bawaslu in the 2019 election is increasing. referring to Law Number 7 of 2017. In the 2019 Election, Bawaslu does not only supervise but can directly take action against election violations, even Bawaslu can prevent money politics from occurring. In an effort to realize democratic elections in 2024, the oversight function that involves elements of society is a major prerequisite, without the support of the involvement of the entire community, supervision will be difficult to realize which will affect the realization of democratic elections in 2024.
