Abstract

Bahwa penyidikan terhadap tindak pidana Illegal Logging di Polres Batanghari mengalami peningkatan dari tahun ke tahun. Oleh karena itu, masalah Illegal Logging yang terjadi di Kabupaten Batanghari harus segera ditangani dengan optimal, sehingga hutan yang ada di Kabupaten Batang Hari tidak semakin musnah. Apabila hutan di Kabupaten Batang Hari fungsi utamanya adalah sebagai penyokong utama kehidupan manusia ternyata musnah karena ulah pihak-pihak tertentu, maka dikawatirkan bencana alam akan sulit terelakkan. Selain itu kehidupan ekosistem akan banyak terganggu dan akan mempengaruhi pada kehidupan. Tujuan penelitian ini untuk menegetahui bagaimana proses penyidikan terhadap tindak pidana penebangan pohon tanpa izin dan untuk mengetahui upaya yang dilakukan untuk mengatasi kendala dalam penyidikan terhadap tindak pidana penebangan pohon tanpa izin (Illegal Logging) di Polres Batanghari. Tipe penelitian ini adalah yuridis empiris, penelitian yang penulis lakukan bersifat Deskriptif analitis. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan: Penyidikan terhadap tindak pidana penebangan pohon tanpa izin di Kabupaten Batanghari oleh penyidik Polres Batanghari dilakukan penangkapan terhadap tersangka, mengamankan barang bukti, melakukan cek ditempat kejadian perkara, melakukan pemberkasan lebih lanjut, pemeriksaan tersangka, pemeriksaan saksi, hingga proses pembuktian di tingkat penyidikan yang dilakukan oleh penyidik Polres Batanghari. kendala yang ditemui dalam penyidikan terhadap tindak pidana penebangan pohon tanpa izin di Kabupaten Batanghari oleh penyidik Polres Batanghari yaitu keterbatas sumber daya penyidik, lokasi tempat penebangan illegal yang sulit dijangkau, pelaku melarikan diri, keterlibatan oknum, masyarakat itu sendiri. Saran penulis sebaiknya penyidik Polres Batanghari dalam melakukan penyidikan, harus sampai ke akar-akarnya, tidak hanya para pekerja penebang pohon dan tukang mengangkut saja namun penadah serta pemodal wajib di usut sampai tuntas. Therefore, the Illegal Logging problem that occurs in Batanghari Regency must be handled optimally immediately, so that the forests in Batanghari Regency are not further destroyed. If the forests in Batanghari Regency, whose main function is to support human life, are destroyed due to the actions of certain parties, it is feared that natural disasters will be difficult to avoid. Apart from that, ecosystem life will be disturbed a lot and will affect life. The aim of this research is to find out the process of investigating the criminal act of felling trees without a permit and to find out the efforts made to overcome obstacles in investigating the criminal act of felling trees without a permit (Illegal Logging) at the Batanghari Police. This type of research is empirical juridical, the research that the author conducted is descriptive analytical. Based on the results of the research and discussion, it can be concluded: The investigation into the criminal act of felling trees without permission in Batanghari Regency by Batanghari Police investigators carried out the arrest of the suspect, securing evidence, checking the scene of the crime, carrying out further filings, examining the suspect, examining witnesses, to the evidentiary process at the investigation level is carried out by Batanghari Police investigators. The obstacle encountered in the investigation of the crime of felling trees without permission in Batanghari Regency by Batanghari Police investigators were limited investigative resources, the location of the illegal logging site being difficult to reach, the perpetrator running away, the involvement of individuals and the community itself. The author’s suggestion is that the Batanghari Police investigators, in carrying out the investigation, must get to the roots, not only the tree fellers and transport workers but also the collectors and financiers who must be investigated thoroughly.
