Abstract

This research is conducted to understand how judges of the Jambi Religious Court apply the principle of making divorce difficult in their rulings. It also examines the considerations of the judges in issuing rulings on divorce lawsuits. In conducting the research, this thesis used a normative juridical research method with a statutory approach, a case approach, and a conceptual approach as analytical tools used in the research. The results of this study show that from various divorce petition decisions, judges in issuing a divorce decision first studied the legal, sociological, and philosophical aspects before issuing a decision. So that the divorce petition decision produces justice, has legal certainty, and can be beneficial to the parties concerned. The application of the principle of making divorce more difficult that is carried out in the Religious Court of Jambi is in accordance with what is stipulated and regulated in the Law and procedural law. However, the implementation of this principle is still quite difficult to implement, this is due to 1) the parties involved in the case feel incompatible, 2) there is no good faith between the two parties.
