Abstract
ABSTRAK Tujuan dari penelitian ini adalah menganalisa Bagaimana pelaksanaan penghentian penyidikan berdasarkan prinsip Restorative Justice di Polresta Jambi dan menganalisa kendala yang di hadapi dalam pelaksanaan penghentian penyidikan berdasarkan prinsip Restorative Justice di Polresta Jambi. Adapun rumusan masalah dalam penelitian ini ialah: 1). Bagaimana pelaksanaan penghentian penyidikan berdasarkan prinsip Restorative Justice di Polresta Jambi 2). Bagaimana kendala yang di hadapi dalam pelaksanaan penghentian penyidikan berdasarkan prinsip Restorative Justice di Polresta Jambi. Metode penelitian dalam skripsi ini menggunakan tipe penelitian hukum empiris yang meliputi pendekatan kualitatif, dengan menggunakan beberapa teknik pengumpulan data seperti wawancara, observasi, dan analisis dokumen. Berdasarkan hasil penelitian yang dilakukan, diketahui bahwa pelaksanaan penghentian penyidikan yang dilakukan di Polresta Jambi berdasarkan Restorative Justice dilaksanakan sebagaimana yang telah tertulis dalam Peraturan Kapolri Nomor 8 Tahun 2021, tentang Penanganan Tindak Pidana Berdasarkan Restorative Justice, yakni Pasal 2. Melalui hasil analisis dokumen diketahui bahwa dari 335 kasus pidana sepanjang tahun 2022 hingga 2023 terdapat 14 kasus yang gagal diberlakukan Restorative Justice , di mana 2 kasus tertinggi di antaranya kasus keroyok dan perlindungan perempuan dan anak. Selanjutnya diketahui kendala penyebab kegagalan tersebut akibat dari ketidakmauan korban diselesaikan secara damai, kurang kooperatifnya kedua pihak, dan adanya konsekuensi hukum. Kata Kunci: Keadilan Restoratif, Penghentian Penyidikan, Polresta Jambi ABSTRACT The aim of this research is to analyze how the termination of investigations is implemented based on the principles of Restorative Justice at the Jambi Police and to analyze the obstacles faced in implementing the termination of investigations based on the principles of Restorative Justice at the Jambi Police. The problem formulation in this research is: 1). How is the implementation of terminating investigations based on the principles of Restorative Justice in the Jambi Police 2). What are the obstacles faced in implementing the termination of investigations based on the principles of Restorative Justice at the Jambi Police. The research method in this thesis uses an empirical legal research type which includes a qualitative approach, using several data collection techniques such as interviews, observation and document analysis. Based on the results of the research carried out, it is known that the implementation of the termination of investigations carried out at the Jambi Police based on Restorative Justice is carried out as written in the National Police Chief Regulation Number 8 of 2021, concerning Handling of Crimes Based on Restorative Justice, namely Article 2. Through the results of document analysis it is known that Of the 335 criminal cases from 2022 to 2023, there were 14 cases where Restorative Justice failed to be implemented, of which the 2 highest cases were cases of gang violence and the protection of women and children. Furthermore, it is known that the obstacles that caused the failure were the result of the victim's unwillingness to resolve it peacefully, the lack of cooperation between both parties, and the existence of legal consequences.
