Abstract

ABSTRAK Tujuan dari penelitan ini adalah untuk menganalisis dan memahami faktor-faktor yang menjadi penyebab belum optimalnya pelaksanaan Restorative Justice di Polres Muaro Jambi. Dimana yang dimaksud Restorative Justice ialah pendekatan alternatif di dalam penegakan hukum yang berfokus pada pemulihan hubungan antara pelaku dan korban kejahatan, serta masyarakat. Adapun yang menjadi rumusan masalah dalam penelitian yaitu: 1). Apakah faktor penyebab belum optimalnya pelaksanaan Restorative Justice di Polres Muaro Jambi 2). Apa saja kendala yang menyebabkan belum optimalnya pelaksanaan Restorative Justice di Polres Muaro Jambi. Metode penelitian dalam penulisan skripsi ini menggunakan tipe penelitian yuridis empiris yang pengkajiannya dilakukan dengan cara meneliti data sekunder terlebih dahulu baru kemudian dilanjutkan dengan melakukan penelitian terhadap data primer di lapangan seperti wawancara, survei, dan juga kuesioner. Hasil penelitian diketahui bahwa: 1). Pelaksanaan Restorative Justice di Polres Muaro Jambi belum sepenuhnya optimal. Yang menjadi faktor penyebab belum optimalnya pelaksaan Restorative Justice tersebut ialah dalam beberapa kasus, antara korban dan pelaku tidak ditemukannya kata sepakat dikarenakan korban sulit memaafkan pelaku, ganti rugi tidak sesuai dengan keinginan korban dan masyarakat beranggapan bahwa pelaku harus dipidana agar jera 2). Dalam pelaksaannya Restorative Justice melibatkan beberapa pihak diantaranya korban, pelaku, penyidik, dan masyarakat. Namun, dalam pelaksaannya masih terdapat kendala seperti, kurang nya pengetahuan masyarakat mengenai Restorative Justice yang mengakibatkan masyarakat tidak setuju dilaksanakannya Restorative Justice, pelaku tidak dapat memenuhi permintaan korban sebagai alasan dilaksanakannya Restorative Justice, dan juga keluarga korban menginginkan pelaku untuk dipidana saja daripada harus melakukan Restorative Justice. Kata Kunci: Keadilan Resoratif, Optimalisasi, Polres Muaro Jambi ABSTRACT The aim of this research is to analyze and understand the factors that cause the implementation of Restorative Justice not yet be optimal at the Muaro Jambi Police. What is meant by Restorative Justice is an alternative approach to law enforcement that focuses on restoring relationships between perpetrators and victims of crime, as well as the community. The problem formulation in the research is: 1). What are the factors causing the implementation of Restorative Justice not yet optimal at the Muaro Jambi Police Station 2). What are the obstacles that cause the implementation of Restorative Justice at the Muaro Jambi Police Station to not be optimal. The research method in writing this thesis uses a type of empirical juridical research in which the study is carried out by examining secondary data first and then continuing by conducting research on primary data in the field such as interviews, surveys and also questionnaires. The research results show that: 1). The implementation of Restorative Justice at the Muaro Jambi Police is not yet fully optimal. The factor that causes the implementation of Restorative Justice to not be optimal is that in several cases, there is no agreement between the victim and the perpetrator because the victim finds it difficult to forgive the perpetrator, compensation is not in accordance with the victim's wishes and the community thinks that the perpetrator must be punished to deter them 2). In its implementation, Restorative Justice involves several parties including victims, perpetrators, investigators and the community. However, in its implementation there are still obstacles such as the lack of public knowledge regarding Restorative Justice which results in the community not agreeing to the implementation of Restorative Justice.
