Abstract

Suku Anak Dalam 113 Bungku has received the results of their very long struggle in fighting for their customary land rights. On December 1, 2022, at the State Palace in Central Jakarta, President Joko Widodo awarded the Communal Rights Certificate or Joint Rights to the Suku Anak Dalam 113 Bungku, and there was a transfer of land which initially was in Bungku Village, moved to Singkawang Village with a distance of approximately 30 Km. This study aims to determine how the arrangement and legal consequences of the certification of Communal Land Rights of the Suku Anak Dalam 113 Bungku are. This study uses a normative legal research type. The result obtained is that in the Minister of ATR/Head of BPN Regulation Number 10 of 2016 concerning Procedures for Determining Communal Rights Over Customary Law Community Land and Communities in Certain Areas, it intends to provide legal protection for the land of customary law communities, but the ministerial regulation does not use the term customary rights as mentioned in the Basic Agrarian Law but using the term communal rights results in a normative ambiguity that cannot guarantee legal certainty over the land obtained by the Suku Anak Dalam 113 Bungku. The existing normative ambiguity can cause the communal rights certificate of the Suku Anak Dalam 113 Bungku to be canceled and can also result in being null and void by law. There is a need for a renewal through the ATR Ministerial Regulation to pay attention to every characteristic inherent in indigenous law communities, especially communal rights, so that every right of indigenous law communities can be protected.
