Abstract
Dalam kehidupan masyarakat Adat Batak Karo sampai saat ini masihmenjalankan adat istiadat dengan sangat rekat dapat dilihat pada kegiatan - kegiatan yang masih dilakukan sampai sekarang.Tujuan dilakukanpenelitianiniadalahuntukmengetahui dan menganalisispelaksanaanputusan No. 23/Pdt.G/2009/PN. Kbjterhadappembagianwarisan pada masyarakatadat Karo dan Untukmengetahuikebijakan/tindakanmasyarakatadat Karo terhadappelaksanaanputusan No. 23/Pdt.G/2009/PN.Kbj. Rumusanmasalahdalampenelitianiniyaitu : 1. BagaimanapelaksanaanputusanNo. 23/Pdt.G/2009/PN. Kbjterhadappembagianwarisan pada masyarakatadat Karo? 2. Bagaimanakebijakanmasyarakatadat Karo terhadappelaksanaanputusan No. 23/Pdt.G/2009/PN.Kbj? Metode penelitian yang digunakanyaitupenelitian hukum yuridis empiris, sertamenggunakanbahanhukum primer,sekunder dan tersier. Penelitianinidilakukan di Kabupaten Karo, Provinsi Sumatera Utara. Hasil daripenelitianiniadalahBahwa pelaksanaan putusan No 23/Pdt.G/2009/PN.Kbj belum terlaksana dimana hukum waris adat Batak Karo memiliki prinsip bahwa hanya pihak laki-laki saja yang dijadikan sebagai ahli waris utama, sedangkan pihak perempuan juga dianggap sebagai ahli waris, hanya saja bagian warisnya didapatkan atas dasar Keleng Ate dan seiringberkembangnyazamandanpemikiranmanusia, keberadaan hukum waris adat Batak Karo bagi sebagianmasyarakatmenganggap perlu diadakannya penyesuaian,karena mereka merasa tidak mungkin tetap melaksanakan aturan adat sesungguhnya tanpa melakukan penyesuaianyang menyebabkan anak perempuan yang dimiliki tidakmendapatkansedikitpun hakwaris. In the lives of the Karo Batak Indigenous people, to this day they still carry out their customs very closely, which can be seen in the activities that are still carried out today.The purpose of this research is to find out the implementation of decision no. 23/Pdt.G/2009/PN. Kbj regarding the distribution of inheritance to the Karo indigenous community and to find out the policies/actions of the Karo indigenous community regarding the implementation of decision no. 23/Pdt.G/2009/PN.Kbj. The formulation of the problem in this research is: 1. How to implement decision no. 23/Pdt.G/2009/PN. Kbj regarding the distribution of inheritance among the Karo indigenous people? 2. What are the policiesof the Karo indigenous community regarding the implementation of decision no. 23/Pdt.G/2009/PN.Kbj? The research method used is empirical juridical legal research, and uses primary, secondary and tertiary legal materials. This research was conducted in Karo Regency, North Sumatra Province. The results of this research are that the implementation of decision No. 23/Pdt.G/2009/PN.Kbj has not been implemented, where the Karo Batak traditional inheritance law has the principle that only men are made the main heirs, while women are also considered as heirs, it's just that the inheritance portion is obtained on the basis of Keleng Ate and as time and human thought progress, the existence of the Batak Karo traditional inheritance law for some people considers it necessary to make adjustments, because they feel it is impossible to continue implementing the actual customary rules without making adjustments that cause children The woman who owns it does not get any inheritance rights.
