Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis mekanisme penyelesaian sengketa tanah di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin serta kendala-kendala yang dihadapi dalam pelaksanaan penyelesaian sengketa tanah di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin. Permasalahan yang akan diteliti adalah Bagaimana mekanisme penyelesaian sengketa tanah di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin? dan Apa kendala yang dihadapi dalam pelaksanaan penyelesaian sengketa tanah di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin? Metode penelitian yang digunakan adalah yuridis empiris. Lokasi penelitian yaitu di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin. Data yang dikumpulkan baik data primer maupun data sekunder diperoleh menggunakan metode wawancara dan studi pustaka. Hasil penelitian menunjukkan bahwa mekanisme penyelesaian sengketa tanah di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin sudah sesuai dengan norma adat yang berlaku di desa tersebut. Namun, masih ada tantangan yang harus diatasi untuk mencapai penyelesaian akhir yakni sulitnya mencapai kata mufakat. Hal ini dikarenakan solusi yang ditawarkan dinilai belum menguntungkan untuk kedua belah pihak yang bersengketa. Kendala yang dihadapi dalam penyelesaian sengketa tanah di Desa Sumber Agung Kecamatan Margo Tabir Kabupaten Merangin antara lain tidak adanya itikad baik dari salah satu pihak yang bersengketa serta sering mengalami kebuntuan. Kata Kunci: Penyelesaian, Sengketa Tanah This research aims to determine and analyze the mechanism for resolving land disputes in Sumber Agung Village, Margo Tabir District, Merangin Regency as well as the obstacles faced in implementing land dispute resolution in Sumber Agung Village, Margo Tabir District, Merangin Regency. The problem that will be studied is what is the mechanism for resolving land disputes in Sumber Agung Village, Margo Tabir District, Merangin Regency? and What are the obstacles faced in implementing land dispute resolution in Sumber Agung Village, Margo Tabir District, Merangin Regency? The research method used is empirical juridical. The research location is in Sumber Agung Village, Margo Tabir District, Merangin Regency. The data collected, both primary data and secondary data, were obtained using interview and literature study methods. The research results show that the mechanism for resolving land disputes in Sumber Agung Village, Margo Tabir District, Merangin Regency is in accordance with the customary norms that apply in the village. However, there are still challenges that must be overcome to reach a final resolution, namely that in implementing dispute resolution it is difficult to reach consensus. This is because the solution offered is considered not yet profitable for both parties to the dispute. Obstacles faced in resolving land disputes in Sumber Agung Village, Margo Tabir District, Merangin Regency include the lack of good faith on the part of one of the parties to the dispute and frequent deadlocks.
