Abstract

In this study the author analyzes the form of alleged violations committed by PT KPI as an IDN applicant for safeguards, namely a closed tying in agreement. As for the formulation of the problem in this study, how is the alleged Tying in agreement carried out by the Domestic Industry (IDN) applicant for Safeguards, and how to prevent violations committed by the Domestic Industry (IDN) applicant for Safeguards. The purpose of this study is to analyze the alleged violation of the tying agreement committed by the Domestic Industry (IDN) applicant for Safeguards, and legal protection efforts against violations committed by the Domestic Industry (IDN) applicant for Safeguards. The benefit of the research is as a consideration in determining a policy related to the regulation or imposition of import duties on safeguards. The approaches used in this research, such as conceptual approaches, cases, legislation and empirical juridical approach types. The results of this study PT.KPI allegedly violated Article 15 paragraph 2 by using the Per se illegal and rule of reason theoretical approaches. Alleged violations committed by PT.KPI can result in anti-competitive behavior and obstruction of business competition. The safeguards policy should be given to IDNs that do not violate the laws and regulations. In this case, law enforcement functions as legal protection in efforts to prevent and resolve violations of business competition behavior. Therefore, the compliance program created by Kppu is a form of effort to prevent violations of Law Number 5 Year 1999. Keyword: Anti-competitive Behavior, Domestic Industry , Safeguards measures
