Abstract

In fact, the Corporate Social Responsibility (CSR) program carried out by the Company, whether it is a State-Owned Enterprise, must apply the principles of Good Corporate Governance (GCG) to encourage economic growth in the surrounding community in order to realize equitable development, one of the important principles in GCG which is very influential. in CSR is responsibility which is directed not to shareholders but to stakeholders. CSR as a mandatory economic legal instrument is expected to be a means for companies or business entities to realize sustainable development with an environmental perspective. From this background, the main problem is how to regulate the corporate model. Social Responsibility in State-Owned Enterprises in Indonesia, and whether the Corporate Social Responsibility model can realize Good Corporate Governance in State-Owned Enterprises in Indonesia and what is the ideal concept of the Corporate Social Responsibility model in Indonesia in the Context of Realizing Good Corporate Governance, to analyze the objectives of the research Therefore, this research method uses normative juridical legal research methods. The results of this research found that the CSR model in State-Owned Enterprises is still unclear because of Law no. 40 of 2007 states that only companies whose business activities are related to natural resources, so that GCG is a determining factor in implementing Corporate Social Responsibility (CSR) is not optimal. The conclusion of this research is that companies that are not related to natural resources may not carry out CSR. Therefore, as a recommendation from this research, harmonization is carried out with international legal instruments and national legal instruments in the field of company law in order to create harmony and just legal certainty
