Abstract

ABSTRACT The regulation of certain licensing levies has changed, in Law Number 28 of 2009 covers 5 (five) objects of levy, but after the birth of Law Number 6 of 2023 through Law Number 1 of 2022, the regulation has changed to 3 (three) types. This study has an interesting formulation of problems to be studied, namely: First, what is the basis for changing the object of certain licensing levies after the enactment of Law Number 6 of 2023?; Second, what is the impact of changes in the object of certain licensing levies? This research is a normative research with the legal issue of norm ambiguity. The results of this study are as follows: First, the change in the object of the levy is based on realizing the state's goals through job creation by implementing the Constitutional Court Decision Number 91 of 2020 by improving the Job Creation Law so as to create a simplification of the licensing process and there is a change in social dynamics so that there is a simplification of the object of certain licensing levies, Second, the change has an impact on the creation of state goals in prospering the people and the presence of OSS as a simplification of the licensing process so as to create jobs and ensure legal certainty. Although, there is a tendency for regional original income that has the potential to decrease due to the elimination of several types of levy objects.
